The subject of the Procurement is the implementation of the Procurement consisting of the delivery of Factory New Equipment. The deliveries will concern Equipment intended for installation in the transmission network of the Buyer in newly constructed, modernised or expanded power stations. The Equipment offered separately in individual Packages (Parts) must meet all the requirements of the OPZ and the Technical Specification as follows: The subject of the procurement has been divided into 3 Parts: Package 1 - "Delivery of pantograph-type disconnectors". Package 2 - "Delivery of horizontal rotating disconnectors and free-standing earthing switches". Package 3 - "Delivery of knife-type disconnectors". 2. A detailed description of the subject of the procurement is given in Part II SWZ Description of the Subject of the Procurement. 3. In each and every case, the Buyer, by referring to the subject of the procurement to standards, technical assessments, technical specifications and technical reference systems, as mentioned in Article 101(1)(2) and (3) of the Act, the Buyer allows equivalent solutions described, if they allow to achieve features or parameters not worse than those referred to. The above means that the Contractor may apply solutions described by the Buyer "or equivalent". 4. In accordance with Article 101(5) of the Act, the Contractor who refers to solutions equivalent to those described by the Buyer is obliged to prove that the supplies offered by him meet the requirements specified by the Buyer, provided that the Contractor proves in the offer, in particular by means of substantive evidence, as mentioned in Articles 104-107 of the Act, that the proposed solutions in an equivalent degree meet the requirements specified in the description of the subject of the procurement. 5. The Procurement within Package I and II is carried out within the framework of projects co-financed by the European Union within the framework of the CEF 2020 programme and may apply for co-financing within the framework of the National Recovery Plan. The Procurement within Package III may apply for co-financing from EU aid funds. 6. The Buyer will reject the offer in any of the Parts on the basis of Article 393(1)(4) of the Act, in which the share of products, including software used in telecommunications network equipment originating from Member States of the European Union, countries with which the European Union has concluded agreements on equal treatment of entrepreneurs, or countries, in respect of which the provisions of Directive 2014/25/EU are applied by virtue of a decision of the Council, does not exceed 50%. 7. The Buyer reserves the right to invalidate the procedure within Package I and II on the basis of Article 257 of the Act, if the public funds which the Buyer intended to allocate for the financing of the whole or part of the procurement have not been granted to him.
