Poland – Refuse and waste related services – Odbiór i zagospodarowanie odpadów komunalnych od właścicieli nieruchomości zamieszkałych znajdujących się na terenie gminy Kotuń

The subject of the contract is the collection and disposal of municipal waste from owners of residential properties located in the area of the Gmina Kotuń, as well as from the Selective Waste Collection Point located at the Kotuń Waste Dump, in accordance with the provisions of the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (i.e. Journal of Laws of 2021, item 888, as amended), the Waste Act of 14 December 2012 (Journal of Laws 2019, item 701, as amended), the provisions of the Voivodeship Waste Management Plan for Mazovia, and the provisions of the Regulation on maintaining cleanliness and order in the area of Gmina Kotuń, as well as other statutory and local legal provisions. The estimated amount of waste to be collected over the entire period of the contract is 2,064.7 Mg. Additionally, as part of the service provided, the contractor is obligated to collect and dispose of municipal waste from properties under the management of Gmina Kotuń. The contracting authority reserves the right to exercise the option defined in Article 441(1) of the Public Procurement Law. The exercise of the option will involve increasing by 25% the amount of municipal waste to be collected and disposed of, even in the event of exhaustion of the maximum contract amount allocated for the implementation of the basic contract. The option, referred to in paragraph 1, will be exercised on the following terms: 1) it will be exercised on the same terms as the basic contract, 2) the unit price for the collection and disposal of municipal waste under the option will be the same as that of the basic contract, 3) the contracting authority will inform the contractor of its intention to exercise the option by separate letter/declaration, 4) the contracting authority may exercise the option if the maximum contract amount allocated for the implementation of the basic contract has been utilised.
