Poland – Telecommunications facilities – Rozbudowa sieci DWDM

The subject of the contract is the expansion of the DWDM network in Poland for PSE S.A.

The contracting authority's needs and the characteristics of the subject of the contract, as well as the minimum requirements relating to the subject of the contract/implementation of the contract, which are not subject to negotiation and must be met by all offers, are specified in Section II of the OPIW, with the proviso that at the stage of publishing the contract notice, a shortened description of the needs and requirements of the contract will be made available – in accordance with the provisions of Article 18 of the Pzp. Contractors are obliged to submit declarations of confidentiality along with the application for admission to the procedure (templates in Section III of the OPIW). Acting on the basis of Article 381(9) and 133(3) of the Act, the Contracting Authority establishes requirements regarding the confidentiality of information provided to Contractors during the procedure. The following parts of the OPIW are confidential: - Section II OPIW – Description of the subject of the contract; - Section IV OPIW Draft contractual terms. Contractors invited to participate in the next stage of the procedure, i.e. together with the invitation to negotiations, will receive the full description of the subject of the contract (Section II OPIW) and the Draft contractual terms (Section IV OPIW).

The contracting authority does not allow the submission of partial offers.

The contracting authority does not allow the submission of variant offers.

The contracting authority does not reserve the right of personal performance by the contractor of key tasks.

The contracting authority emphasizes that this procedure is being conducted in the sectoral negotiations with a notice. This means that after the submission of applications, the conditions for the implementation of the subject of the contract will be negotiated with the contractors qualified for the second stage of the procedure (these cannot lead to a change in the subject of the contract, including in particular the data indicated in the notice of commencement of the procedure).
