In accordance with Article 28 of the LCSP, the proposed contract is necessary for the fulfilment and achievement of the institutional purposes of the Confederación Hidrográfica del Segura, O.A. (hereinafter CHS). The Technical Directorate of the CHS manages, maintains, conserves and operates 29 large dams of state ownership, and various reservoirs, most of which are classified in Category A due to the potential risk that may arise from their possible failure or incorrect operation. The Technical Safety Standards for Dams and their Reservoirs, approved by RD 264/2021, of 13 April, constitute the current legislation on the safety of dams and reservoirs, which must be complied with, unifying all the prescriptions previously in force and putting an end to the transitional situation in which different standards with different requirements and different levels of security coexisted. The Basic Directive for the Planning of Civil Protection against the Risk of Floods, approved by the Council of Ministers on 9 December 1994 and published in the BOE of 14 February 1995, establishes the minimum requirements regarding foundations, structures, organisation, operational criteria, intervention measures and coordination instruments that must be met by the Special Emergency Plans for floods. Both sets of regulations establish the obligation to classify dams according to the potential risk that may arise from a possible failure or incorrect operation of each dam and that these will be classified according to the damage they may cause to people, urban nuclei, essential services, the environment or economic assets.
