The subject of the present contract is the supply, on a leasing basis, including maintenance of a series of chemical toilets for the Empresa Malagueña de Transportes, S.A.M. As it includes both supply and maintenance services, it is a mixed contract in accordance with Article 15 of Royal Decree-Law 3/2020, of 4 February. The contract is configured as a supply based on needs, in accordance with the provisions of the Additional Provision Thirty-Third of the LCSP. Consequently, it is not possible to determine exactly the specific number of chemical toilets that will be required during the term of the contract. The supply includes distribution, assembly, installation, commissioning, and maintenance for the use of the goods that are the subject of this procurement. For guidance, the locations planned for the chemical toilets in continuous use are listed in section 3.1 of the PCAP. This list of points and codes is merely indicative and may be modified according to the needs of the service, without this implying an obligation on the part of EMTSAM to maintain a fixed number of cabins or to install them necessarily in all the locations indicated. Therefore, the needs may fluctuate upwards or downwards. Similarly, services may be required for special events, such as Christmas, Easter, Fair, works, diversions or new line terminals, etc., in which it is necessary to reinforce or adapt the number and location of the chemical toilets. In all these cases, the awarding person will be obliged to meet the requirements of EMTSAM and to supply the units of chemical toilets requested, in the technical and economic conditions offered and within the response times established in this tender. The subject includes, at least, the following services and supplies: Transport or movement, installation and assembly of the cabins, and removal of the same at the end of the contract, or when EMTSAM requires it. Replacement of the cabin deposit, at least once a week and will be adapted to the needs of the EMTSAM. Cleaning of the cabins: 2 daily cleanings of all the cabins, every working day, Saturdays and holidays. Replacement of consumables: replacement of toilet paper, hand-drying wipes and hand soap twice a day in all the cabins, every working day, Saturdays and holidays. General maintenance, both interior and exterior, of the elements that make up the cabin. All the technical conditions that the contractor must comply with are included in the PPTP.
