Subject of the Contract 1. The subject of the contract are successive deliveries of body care products – toilet paper, towels, liquid soap. 2. The contractor undertakes to deliver, install and maintain free of charge for the duration of the contract, dispensers for the offered products in the quantity specified in the specification. 3. A detailed description of the subject of the contract is contained in Annex No. 3 to SWZ - detailed description of the subject of the contract technical parameters (required, offered). 4. EQUALITY PRINCIPLES. All trade names of products and materials as well as standards and certificates referred to in the specification serve to determine the desired standard of execution and properties as well as the technical requirements set for the subject of the contract. The Purchaser allows the use of equivalent solutions in this case. The Purchaser informs that whenever in the detailed descriptions, the subject of the contract is described by indicating a trademark, patent, origin, technical or quality standards, equivalent solutions are allowed, i.e. those having features, technical, functional and quality parameters not worse than those described in the above elements of the documentation. The Purchaser allows the offering of equivalent solutions in terms of technical, functional and quality parameters, provided that they guarantee the implementation of the subject of the contract in accordance with the assumptions specified in this SWZ. The proof of the equivalence of the offered solution or equivalent solutions lies with the Contractor. 5. The Contractor, who refers to equivalent solutions, is obliged to prove that the solution offered by him meets the requirements specified by the Purchaser. In such a case, the Contractor attaches to the offer a list of equivalent solutions along with its description or standards. 6. In the event that the description of the subject of the contract contains references to standards, technical assessments, technical specifications and technical reference systems, as referred to in art. 101 para. 1 point 2) and para. 3 of the Pzp Act, referred to in the documentation of this procedure, the Purchaser allows solutions equivalent to those described. The Contractor, who refers to solutions equivalent to those described by the Purchaser, is obliged to prove that the supplies, services offered by him meet the requirements specified by the Purchaser. 7. CPV CODE: 33700000-7 8. The conditions of equivalence are specified in Annex No. 5 to SWZ. Foreign Entity 1. If the contractor has its registered office or place of residence outside the territory of the Republic of Poland, instead of: 1) information from the National Criminal Register, as referred to in point 10.1/1 SWZ (Article 2, para. 1, point 1 of the regulation on subject evidence), submits information from the appropriate register, such as the commercial register, or, in the absence of such a register, another equivalent document issued by the competent judicial or administrative authority of the country in which the contractor has its registered office or place of residence, in the scope referred to in point 10.1/1 SWZ (Article 2, para. 1, point 1 of the regulation on subject evidence); 2) a certificate, as referred to in point 10.1/3 SWZ (Article 2, para. 1, point 4 of the regulation on subject evidence), a certificate or other document confirming that the contractor does not owe payments of contributions to social or health insurance, as referred to in point 10.1/4 SWZ (Article 2, para. 1, point 5 of the regulation on subject evidence), or a copy or information from the National Court Register or from the Central Register and Information on Business Activity, as referred to in point 10.1/5 SWZ (Article 2, para. 1, point 6 of the regulation on subject evidence) - submits a document or documents issued in the country in which the contractor has its registered office or place of residence, confirming respectively, that: a) it has not breached obligations related to the payment of taxes, fees or contributions to social or health insurance, b) its liquidation has not been opened, bankruptcy has not been declared, its assets are not managed by a liquidator or a court, it has not concluded an agreement with creditors, its business activity is not suspended nor is it in a similar situation resulting from a similar procedure provided for in the provisions of the place of initiation of that procedure. 2. The document referred to in point 10.2/1/1 SWZ should be issued no earlier than 6 months before its submission. Documents referred to in 10.2/1/2 SWZ should be issued no earlier than 3 months before their submission. 3. If in the country in which the contractor has its registered office or place of residence or the person to whom the document relates has his place of residence, documents referred to in point 10.2/1 are not issued, or if these documents do not relate to all the cases referred to in Article 108, para. 1, points 1, 2 and 4, Article 109, para. 1, points 1, 2, lit. a and b and point 3 of the Act, they are replaced respectively in whole or in part by a document containing respectively a declaration of the contractor, with the indication of the person or persons authorised to represent him, or a declaration of the person to whom the document was to relate, made under oath, or, if in the country in which the contractor has its registered office or place of residence or the person to whom the document was to relate has his place of residence, there are no provisions on the declaration under oath, made before a judicial or administrative authority, a notary, a professional or economic self-government body, competent with regard to the registered office or place of residence of the contractor or the place of residence of the person to whom the document was to relate. The provision of point 10.2/2 applies. TENDER BINDING PERIOD The Contractor will be bound by the submitted offer for a period not longer than 90 days from the expiry of the offer submission deadline, i.e. until 19.01.2027, where the first day of the tender binding period is the day on which the offer submission deadline expires.
