Poland – Servers – Dostawa wraz z instalacją serwerów na potrzeby procesów wytwórczych wraz ze wsparciem technicznym

1. The subject of the contract is the delivery and installation of servers for manufacturing processes, along with technical support. 2. The subject of the contract is detailed in Section II of the SWZ – Description of the subject of the contract. 3. The contracting authority, pursuant to Article 139 of the Pzp Act, provides for a reverse order of evaluation of offers, i.e. first it will examine and evaluate the offers, and then it will qualify the Contractor whose offer was the highest, in terms of the absence of grounds for exclusion and meeting the conditions for participation in the procedure. 4. The contracting authority is the administrator of personal data within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, hereinafter "GDPR". 5. The Contractor submits the offer via the eZamówienia Platform of the Public Procurement Office - https://ezamowienia.gov.pl/pl/ 6. The contracting authority reserves the right to cancel the procurement procedure, pursuant to Article 257 of the Pzp Act, if the public funds that the contracting authority intended to allocate for the financing of the contract are not granted to it. 7. The offer is submitted, under penalty of invalidity, in electronic form, according to the requirements strictly defined in the SWZ. 8. The contracting authority will not award the contract if the circumstances referred to in Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJEU L 229/1 of 31.7.2014, as amended) occur and will exclude the Contractor in the event of the occurrence of at least one of the grounds for exclusion specified in Article 7(1) of the Act of 13 April 2022 on special solutions to counter the support of aggression against Ukraine and serving to protect national security (i.e. Journal of Laws of 2025 item 514) – in order to confirm the absence of grounds for exclusion, a declaration constituting Annex No 7 to the Offer Form must be submitted with the offer. 9. Delivery to the Location and transfer of ownership of the Equipment, i.e. 6 units of Type 1 servers (computational) and 3 units of Type 2 servers (management), along with the Software and ensuring the Licences necessary for the proper functioning of the Equipment, Installation of the Equipment in RACK cabinets at the Location and handover to the Contracting Authority of the Documentation, including post-installation documentation, and other data and documents referred to in § 5(1) and (10) of the Agreement; - within a maximum period of 45 days from the date of conclusion of the Agreement – no later than 15.12.2026; 10. Provision of a Warranty for the Equipment for a period of 60 months from the date of acceptance indicated in the Final Acceptance Protocol signed by the Parties; 11. Provision of Technical Support for the Equipment and Software for a period of 60 months from the date of acceptance indicated in the Final Acceptance Protocol signed by the Parties. 12. The contracting authority requires the submission of subject-specific evidence with the offer, to confirm the conformity of the offered supplies with the requirements specified in Section II of the SWZ – Description of the Subject of the Contract. Detailed information on the subject-specific evidence submitted is given in point 6 of Section I of the SWZ.
