Description

a) The subject of the contract is a social service provided 24/7, every day of the week, consisting of the physical protection of the tram tunnel KST along with two stops "Dworzec Główny" and "Politechnika" and the protection of the lower level of Ronda Mogilskiego in Kraków, based on the applicable legal acts:

- Act on the protection of persons and property of 22 August 1997 (Journal of Laws 2021 item 1995),

- Act on means of direct coercion and firearms of 24 May 2013 (i.e. Journal of Laws 2026 item 244),

- Regulation of the Minister of Infrastructure of 23 June 2003 on information on safety and health protection and the safety and health protection plan (Journal of Laws 2003 No. 120 item 1126)

b) The Contracting Authority has described the subject of the contract using the following attachments: the draft contract clauses (PPU) constituting attachment no. 2 to SWZ; the material scope constituting attachment no. 6 to SWZ

c) The security services will be performed by workers entered on the list of qualified physical security workers, possessing a certificate of entry on the list of qualified physical security workers in accordance with the Act of 22 August 1997 on the protection of persons and property.

d) The Contracting Authority, in accordance with Article 121 of the Pzp Act, reserves the obligation of personal performance by the Contractor of the key parts of the contract. By key parts of the contract, the Contracting Authority means: the provision of direct physical protection of persons and property on the protected premises by the Contractor's employees and the immediate intervention by their own Intervention Group (Subcontractors are not allowed in the above scope). In the event that contractors jointly apply for the contract, the scope of activities indicated above must be carried out by the Contractor who holds a current Licence from the Minister of Internal Affairs and Administration to conduct activities related to the protection of persons and property in accordance with the Act of 22 August 1997 on the protection of persons and property (Journal of Laws 2021 item 1995)

e) The Contracting Authority, in accordance with Article 95(1) of the PZP Act, requires the Contractor to employ, on the basis of an employment relationship, persons performing the activities indicated below: Physical security workers - performing activities specified in the Material Scope, i.e. in attachment no. 6 to SWZ The Contracting Authority allows the possibility of personal performance of the contract by persons conducting business activity or partners of a commercial company.

f) Before submitting an offer, the Contractor is obliged to carry out a site visit. Failure by the Contractor to carry out a site visit will result in the rejection of their offer in accordance with Article 226(1)(18) Pzp. The site visit will take place on 15.10.2026 during the working hours of the Contracting Authority, after prior confirmation of participation in the visit to the employees of the Department of Maintenance of Engineering Objects ZDMK: Mr. Krzysztof Kozik (tel. no.: 12 6167556), Ms. Katarzyna Biadała (tel. no.: 12 6167292). Confirmation of the site visit will be a protocol signed by representatives of the Contracting Authority and the Contractor.

g) Service implementation period: from 01.12.2026 to 30.11.2028.

h) The procedure for awarding the public contract is conducted on the basis of the provisions of Article 132 in connection with Article 359(1) of the Pzp Act and Article 360(3) of the Pzp Act.
