Poland – Miscellaneous food products – Dostawy różnych produktów spożywczych

1. The subject of the contract is the successive delivery of various food products to the Police School in Piła. 2. A detailed description of the subject of the contract and the full list of the assortment subject to delivery, as well as the estimated quantity of the ordered products, are given in the Quantity Specification, which is Annex 2 to the SWZ. This annex is part of the offer and must therefore be submitted in the form provided for the offer. 3. The quantities given are estimated and do not oblige the Buyer to purchase the products in these quantities. 4. The Buyer reserves the right not to implement the subject of the contract up to 50% of the total gross remuneration. For the non-implementation of part of the contract, the Contractor is not entitled to any financial or legal claims. 5. The Buyer does not divide the contract into parts. Therefore, the Buyer does not allow the submission of partial offers, as referred to in art. 7 point 15 of the Pzp Act. 6. The delivery, unloading and bringing in of the subject of the contract will be carried out at the Contractor's expense, included in the price of the products covered by the contract for the award of the public contract. 7. The delivery of the subject of the contract will be carried out by the Contractor's transport means authorised to transport food. 8. The Contractor undertakes to deliver the subject of the contract in collective packaging, sorted and protected against damage, under the temperature conditions recommended by the manufacturer and in a clean transport medium adapted to the transport of the subject of the contract. 9. The Contractor is obliged to have an up-to-date certificate of entry in the register of establishments subject to official control of the competent authorities – in accordance with the Act of 25 August 2006 on Food and Feed Safety (i.e. Journal of Laws of 2023, item 1448) or an up-to-date administrative decision on entry in the register of establishments or on the approval of the establishment issued by the district veterinary surgeon together with the assigned identification number in accordance with art. 21 para. 4 of the Act of 16 December 2005 on Products of Animal Origin (i.e. Journal of Laws of 2023, item 872 with later amendments). The Contractor must be under the constant supervision of the competent authorities. 10. The offered products must meet the requirements set out in the applicable legal provisions concerning the production and trade in food. Each product must be produced and placed on the market in accordance with the requirements of the HACCP system. 11. The Contractor is obliged to implement the contract on the principles and conditions described in the Draft Contract Terms, which is Annex 3 to the SWZ. 12. The contract will be implemented successively: from the date of signing the contract, no earlier than from 1 March 2027 to 31 December 2027 or until the total gross remuneration resulting from the contract is exhausted earlier. 13. In accordance with art. 455 para. 1 point 1 of the Act, the Buyer reserves the right to extend the contract implementation period by 2 months after the date specified in the contract, within the financial means designated for this purpose and the request to conclude an annex to the contract in this respect, in the event that the financial means resulting from the concluded contract are not exhausted within the scheduled period and the Contractor has not yet been selected as a result of the next procedure. 14. The delivery of goods will take place up to 2 times a week from Monday to Friday from 06:00 to 11:00 at the Contractor's expense and risk. In justified cases, the Buyer may require the Contractor to implement deliveries also on Saturdays from 06:00 to 11:00. 15. Place of performance of the contract: the food warehouse of the Food Section of the Police School in Piła, Plac Staszica 3, 64-920 Piła.
