The subject of the contract is the repair of tram parts and components, as specified in Appendix 3 to the SWZ, divided into: 1) Group I – Brake shoes for trams: Tatra (RT6 MF06 AC), Moderus Gamma, 2) Group II - Replacement of rims - Solaris Tramino S105p, 3) Group III - Brake shoes for Siemens NGT6D tram, 4) Group IV - Brake shoes for Siemens Combino tram. 2. Under the option right, the Purchaser reserves the right to extend the subject of the contract for a period not longer than 6 months from the expiry date specified in Section IV of the SWZ, in accordance with § 6, paragraph 2 and 3 and § 10 of Appendix 6 to the SWZ (Ppu template) up to 30% of the base contract. 3. The technical conditions for the execution and acceptance of components and elements subject to repair are specified in Appendix 5 to the SWZ. 4. Based on the Appendices to the SWZ No. 3 (Price Form) and No. 5 (Technical conditions for the execution and acceptance of components and elements subject to repair) – the annexes to the contract will be prepared. 5. The Purchaser allows the possibility of submitting partial offers for individual complex groups. 6. The Purchaser does not allow the possibility of submitting partial offers within a given group. 7. The Purchaser does not allow the possibility of submitting alternative offers. 8. The Purchaser does not envisage the conclusion of a framework agreement or the conduct of an electronic auction. 9. The Purchaser allows the possibility of entrusting the implementation of the subject of the contract to subcontractors. In such a case, the Contractor, in Appendix 2 to the SWZ (Offer Form), will indicate the parts of the contract, the execution of which it intends to entrust to subcontractors and will provide the names of the subcontractors if they are already known. The Contractor is responsible for the actions or omissions of the subcontractors as for its own. 10. The Purchaser does not require the submission of evidentiary documents in the subject matter. 11. The Purchaser, in the subject matter procedure, uses the right to restrict access to contracts for Contractors from third countries, with which the European Union is not bound by any international agreement guaranteeing, on the basis of reciprocity and equality, access to the market of public contracts. This restriction consists in not allowing participation in the procedure. 12. The Purchaser does not allow Contractors (as well as Contractors jointly applying for the contract, at least one of whom is) with a registered office (respectively: place of residence) in countries other than a Member State of the European Union, a State of the European Economic Area, a State Party to the Agreement on Government Procurement (GPA) concluded within the framework of the World Trade Organization or a State Party to an agreement concluded with the European Union regulating mutual access to public contracts to participate in the procedure. 13. The Purchaser does not allow Contractors (as well as Contractors jointly applying for the contract, at least one of whom is) with a registered office (respectively: place of residence) in a Member State of the European Union, a State of the European Economic Area, a State Party to the Agreement on Government Procurement (GPA) concluded within the framework of the World Trade Organization or a State Party to an agreement concluded with the European Union regulating mutual access to public contracts, to invoke the technical and professional capabilities or financial or economic situation on the basis described in Article 118 of the Pzp Act, of entities with a registered office (respectively: place of residence) in countries other than a Member State of the European Union, a State of the European Economic Area, a State Party to the Agreement on Government Procurement (GPA) concluded within the framework of the World Trade Organization or a State Party to an agreement concluded with the European Union regulating mutual access to public contracts. 14. The Purchaser, upon receiving an offer from a Contractor from outside the EU, will verify whether the offer is covered by the agreements concluded by the EU regarding the awarding of public contracts in an international context, such as the GPA or free trade agreements, in order to establish whether the Contractor has obtained access to this contract. 15. On the basis of Article 226, paragraph 1, point 5 of the Pzp Act, as non-compliant with the conditions of the contract, the Purchaser will reject the offer submitted by a Contractor from a third country, which has not concluded the Agreement on Government Procurement (GPA) or a bilateral free trade agreement between the EU and that country, guaranteeing, on the basis of reciprocity and equality, access to the market of public contracts. 16. The Purchaser may invalidate the procedure for awarding the contract appropriately before the expiry of the offer submission deadline, if circumstances arise that make it unreasonable to continue the procedure, in accordance with Article 256 of the Pzp Act.
