Description

The procurement of "Physiotherapy Equipment for the University Centre of Physio-Kinotherapy and Medical Recovery", in accordance with the specifications in the terms of reference. Number of days within which requests for clarification can be submitted before the deadline for submission of tenders / applications: 20 days. The contracting authority will respond clearly and fully to all requests for clarification: on the 11th day before the deadline set in the call for participation for the submission of tenders. Any request for clarification must be sent in SEAP (https://www.e-licitatie.ro). The completion of the award procedure by concluding the public procurement contract is subject to the following suspensive condition, which will operate for a maximum period of 3 months from the deadline for tender submission: The conclusion of the public procurement contract is conditional on the maintenance of funding from own revenues/state budget, the signing of the contract being possible only in the situation where the provisions regarding the commitment of expenditures from budgets that fall under the scope of the legislation on public finances are respected, and with the respect of the provisions of Decision no. 395/2016 for the approval of the Methodological Norms for the application of the provisions regarding the award of the public procurement contract/framework agreement from Law no. 98/2016 on public procurement, with subsequent amendments and additions. In the event that, for whatever reason, the maintenance of funding from own revenues/state budget is not achieved, the contracting authority will apply the provisions of art. 212 para. (1) lit. c) point II of Law no. 98/2016, with subsequent amendments and additions, making it impossible to conclude the public procurement contract. Tenderers within this procedure understand that the Contracting Authority and/or MEC cannot be considered responsible for any damage in the event of cancellation of the award procedure, regardless of the nature of the damage and regardless of whether the Contracting Authority and/or MEC have been notified of the existence of such damage. Tenderers within this procedure accept the use of the above special conditions/suspensive clause, assuming full responsibility in relation to any potential damages they may suffer in the described situation.
