The order includes the performance of maintenance works on tree planting, i.e. pruning trees, removing dry, broken and hanging branches from trees growing along provincial roads: a) Task No. 1: - No. 809 Przytoczno – Lublin – 97 units, - No. 828 Garbów – Krasienin – 364 units, - No. 833 Chodel – Kraśnik – 1 unit, - No. 848 Zemborzyce Tereszyńskie – Modliborzyce – 43 units. b) Task No. 2: - No. 834 Niedrzwica Duża – Stara Wieś – 2 units, - No. 836 Bychawa – Piaski – 230 units, - No. 842 Rudnik Szlachecki – Wysokie – 210 units, - No. 848 Zemborzyce Tereszyńskie – Modliborzyce – 43 units. 2. The order will involve cutting branches to shape the tree crown, achieve the appropriate clearance of 4.5 m above the road and 2.2 m above the pedestrian path, and remove dry, broken or hanging branches from the trees. 3. Works within the tree crown must not result in the removal of branches exceeding 30% of the crown. 4. Due to the significant height and size of some of the trees designated for maintenance, the Contractor is obligated to perform the necessary works using alpine methods or with the aid of high-reach lifts. 5. The roadway will be handed over within 7 days from the date of signing the contract. 6. Completion works a) chopping of branches obtained during the service or their removal b) disposal of branch stumps or branches c) tidying the area after completion of the works. 7. Trees designated for pruning will be indicated by an authorised employee of the Road District in Bełżyce and Krzczonów. 8. The services must be performed in accordance with the Technical Specification, Safe Work Instruction for Pruning and Tree Maintenance, ensuring the required quality, and in accordance with the Act on Nature Conservation of 16 April 2004 (Journal of Laws of 2016, item 2134, as amended). 9. The Contractor is liable for any damage caused to ground infrastructure (electricity, telephone, fences, etc.) during the performance of the subject works. 10. The Contractor is obligated to handle waste generated during the execution of the order in accordance with the Act on Waste of 14 December 2012 (Journal of Laws of 2016, item 1987). 11. The Contractor provides all necessary materials, means (including transport), equipment and personnel required to complete the order. 12. Preparation of the workplace, possible power outages, road closure is the responsibility of the Contractor and is included in the unit price. 13. The Contractor is obligated to ensure safe road and pedestrian traffic conditions in the area of the services covered by the contract, based on the temporary traffic organisation project provided by the Contracting Authority. 14. The Contractor ensures the marking of the services during their performance at their own expense. 15. The Contractor will maintain the roadway on an ongoing basis. 16. The Contracting Authority allows for the possibility of submitting partial offers. An offer can be submitted for one or both tasks. 17. The Contracting Authority provides requirements specified in Article 95(1) of the Pzp Act regarding the employment by the Contractor or subcontractor, based on an employment contract, of persons performing activities, as referred to in point XXVI.1.SWZ, in the scope of order implementation. 18. Order completion deadline: 45 days from the date of signing the contract. 19. In accordance with Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU L 119 of 04.05.2016, p. 1), hereinafter "GDPR", I inform you that: - The Data Controller of your personal data is the Director of ZDW in Lublin, ul. Detailed information on the GDPR can be found in the order documentation. 20. The Contracting Authority, in accordance with Article 139(1) of the Pzp Act, will first examine and evaluate the offers, and then qualify the Contractor, whose offer was the highest rated, in terms of the absence of grounds for exclusion and compliance with the participation conditions in the procedure. 21. The Contracting Authority, in accordance with Article 455(1)(1) of the Public Procurement Law, provides for the possibility of changing the contract, specified in detail in the contract project. 22. The Contracting Authority does not require the deposit of a bid bond. 23. The Contracting Authority does not require the deposit of a guarantee of proper contract performance. 24. The Contracting Authority considers that the contractor meets the condition: 1) experience of the Contractor if the Contractor: has performed, in the last 3 years before the deadline for submitting offers, or if the period of business activity is shorter – in this period, at least one service involving the maintenance of tree planting, the value of which was at least for task no. 1 - 45,000.00 PLN gross, for task no. 2 – 40,000.00 PLN gross, performed properly. The description, value, date of performance, and name of the entity for which the service was performed must be provided in the JEDZ declaration. The Contracting Authority will assess compliance with this condition based on the JEDZ declaration. In the case of applying for more than one task, evidence of performance of the service with the highest value among the tasks for which the Contractor is applying must be provided. Due to the lack of applicable regulations issued under Article 5(5) of the Act on the Certification of Contractors, the Contracting Authority does not specify the conditions for participation in the procedure with the application of capability levels.
