The subject of the public contract is the provision of project and architectural services consisting of the preparation of the detailed project documentation, in accordance with Act No. 283/2021 Coll., the Building Act (hereinafter the "Building Act") and in the scope set out in Decree No. 131/2024 Coll., on building documentation, and Decree No. 169/2016 Coll., on the scope of documentation for public contracts for building works and the list of building works, supplies and services with a schedule of quantities. The contracting authority already has part of the project documentation prepared, corresponding to the project documentation for a joint spatial and building permit, which forms Annex No. 2 to the Tender Documentation and from which the Contractor will proceed, or rather, in its completion to the phase of project documentation for the implementation of the construction (DPS), which will be the realization of the Public Contract. The contracting authority states that the subject of this public contract also includes the following activities: a) preparation of the basis for the selection of the construction supplier, in particular the cooperation of the Contractor in the preparation of the tender conditions and tender documentation for the public contract for building works, including the incorporation of the client's requirements into the tender documentation; b) cooperation of the Contractor in the tendering process for the construction supplier, in particular participation in the meetings of the evaluation commission, expert assessment of tenders in the scope relating to the project documentation, technical solution, list of works, schedule of quantities and budget, as well as cooperation in dealing with requests from suppliers for clarification of the tender documentation pursuant to Section 98 of Act No. 134/2016 Coll., on Public Procurement, as amended; c) performance of the Contractor's author's supervision as the designer during the construction, i.e. the Contractor's supervision to ensure that the construction is carried out in accordance with the approved project documentation, including the provision of necessary explanations, statements and cooperation with the client and the construction contractor during the construction. The contracting authority, on the other hand, states that the subject of the public contract is not engineering activities.
