Poland – Refuse and waste related services – Odbieranie i zagospodarowanie odpadów komunalnych na terenie Gminy Gać w roku 2027

The subject of the contract is the provision of a service for the collection and disposal (recovery or neutralisation) of municipal waste from property owners residing in the area of the Gmina Gać, in a manner that ensures the achievement of the required legal levels of preparation for reuse and recycling, the level of landfilling, and other levels and indicators required by regulations. The service will be carried out in accordance with the Act of 13 September 1996 on maintaining cleanliness and order in municipalities, the executive regulations, the current records of the Waste Management Plan for the Podkarpackie Voivodeship during the contract period, the local law acts of the Gmina Gać, and other legal regulations in force during the contract period.

3. The detailed description of the subject of the contract is contained in Annex No. 6 to the SWZ and the executive resolutions. 3a. For the purpose of calculating the offer price, an estimated mass of 1,200 Mg is assumed. The minimum scope of the contract, which the Contracting Authority does not unilaterally limit, is 840 Mg of total waste mass, with the reservation of the rules concerning the actual quantity of waste specified in the OPZ and the projected provisions of the contract. 3b. The requirements regarding the vehicles used to carry out the contract, including the obligations arising from the regulations on electromobility and alternative fuels, are specified in point 8 of the OPZ.

4. The detailed scope of the contract, which are the projected provisions of the contract regarding the public contract, is in the contract template, which is Annex No. 5 to the SWZ. 5. In accordance with Article 257 of the uPzp, the Contracting Authority envisages the possibility of invalidating the substantive procedure if the funds that the Contracting Authority intended to allocate for the financing of the whole or part of the contract have not been granted to it. 6. The Contracting Authority envisages the application of the so-called reverse procedure, as mentioned in Article 139(1) of the uPzp, i.e. the Contracting Authority will first carry out an examination and evaluation of the offers, and then carry out the substantive qualification of the Contractor, whose offer was rated the highest, in terms of the absence of grounds for exclusion and the fulfilment of the conditions for participation in the procedure. 7. The Contracting Authority envisages the possibility of awarding contracts, as mentioned in Article 214(1) point 7 of the uPzp, (50% of the value of the basic contract) consisting in the repetition of the same services of collection and disposal of municipal waste in order to ensure the continuity of the system, with remuneration settled on the basis of the actual mass according to the unit prices negotiated on the basis of the indexed prices from the basic offer. 8. The Contracting Authority does not envisage the conduct of an electronic auction. 9. The Contracting Authority does not envisage the conclusion of a framework agreement. 10. The Contracting Authority does not envisage the right of option.
