Description

The subject of the order is the delivery of computer equipment to the purchaser's premises, in accordance with the purchaser's requirements specified in the Detailed requirements for the subject of the order (Part IV SWZ). The order has been divided into the following parts: Part No. 1 – Workstations with accessories, Part No. 2 – Mobile application compilation and testing kit. 2. The detailed requirements for the subject of the order form an integral part of the description of the subject of the order and are contained in Part IV SWZ, where, in accordance with the provisions of Article 99(6) of the Pzp Act, the purchaser indicated the criteria used to assess equivalence. 3. The contractor is obliged to provide the purchaser with a quality guarantee on the terms of the manufacturer's guarantee. The requirements regarding the guarantee have been specified in Part III SWZ. 4. The delivered subject of the order must be factory new, not exhibited at fairs, complete and technically functional. The term "factory new" means the subject of the order originally packaged, unused before the date of delivery, with the exception of use necessary to test its correct operation after production. 5. The subject of the order must be free from any physical or legal defects or claims of third parties. 6. The delivered subject of the order must come from the producer's distribution channel, not excluding distribution to the Polish market and ensuring the implementation of warranty rights. 7. The subject of the order must be delivered with operating instructions, drivers, and any accompanying software necessary for the correct use of the subject of the order (achieving full functionality as indicated in Part IV SWZ). The purchaser will not be obliged to pay any additional charges, in particular licensing fees, and any licenses will be granted as part of the contractor's remuneration, without time or territorial limitation, unless otherwise clearly indicated in Part IV SWZ. 8. The delivered subject of the order intended to be powered from the power grid must be equipped with the appropriate number of power supply cables allowing it to be connected to standard power sockets, unless otherwise indicated in Part IV SWZ. 9. The offered subject of the order on the date of preparation of the offer may not be intended by the producer for withdrawal from production or sale. 10. The purchaser requires that the offered subject of the order, including ICT products, ICT services and ICT processes used to implement the order, does not include: • ICT products, ICT services or ICT processes indicated in the recommendation referred to in Article 33(4) of the Act of 5 July 2018 on the national cybersecurity system, stating their negative impact on the fundamental interest of the state's security; • an ICT product, the type of which has been determined in a decision on recognising the supplier as a high-risk supplier, referred to in Article 67b(15) of the Act of 5 July 2018 on the national cybersecurity system, or ICT services or ICT processes specified in that decision. Failure to meet the above requirements will result in the rejection of the offer on the basis of Article 226(1) point 17 or point 19 of the Pzp Act. 11. Whenever in the SWZ there is mention of an ICT solution, ICT element, ICT product, ICT service or ICT process, this should be understood as an ICT product, ICT service or ICT process, as referred to in the Act of 5 July 2018 on the National Cybersecurity System (hereinafter also the Act on KSC). 12. Since the subject of the order covered by parts 1 and 2 consists of hardware components and related system and application software, therefore, verification in terms of the requirements referred to in point 10 will apply to both the main elements and the components, elements of the service environment or accompanying solutions. 13. The offered subject of the order covered by parts 1 and 2 must have a CE conformity marking (CE mark) or a CE declaration of conformity. In cases where the offered subject of the order is not subject to the obligation to mark with the CE mark, such a subject must have a declaration of conformity with the RoHS directive or be marked with the RoHS mark – the positions subject to marking have been specified in Part IV SWZ.
