The subject of the contract is the supply of food items from 1 January 2027 to 31 December 2027 to the Contracting Authority's premises, in the assortment and estimated quantities given in the tables (Appendix to SWZ No. 1a/b/c/d/e/f/g/h/i/j, price list). The Contracting Authority informs that the contract has been divided into ten parts. Contractors are entitled to submit an offer for any number of contract parts. 2)The frequency of delivery of goods covered by the contract will take place successively and in quantities depending on the needs of the Contracting Authority. 3)The estimated quantities of goods to be delivered over 12 months, as given in the tables, are the basis for calculating the offer price, which may change depending on the current needs. The Contracting Authority guarantees the execution of the contract in quantities of min ± 20%, i.e. from 80% to 120% of the estimated quantity of goods. For these quantities of the contract, the gross price, converted to 1 unit of measure of the given assortment, will be valid for the entire duration of the contract, except for cases indicated in the contract draft or resulting from circumstances indicated in the laws. For the purposes of determining the price of offers, the estimated quantities indicated in the individual appendices of the given part of the contract will apply. 4)Delivery of goods will be made by the Contractor's own transport and at their own expense to the Contracting Authority's premises (food warehouses at SP ZOZ Sanatorium Uzdrowiskowe MSWiA "AGAT", ul. Cervi 14, Jelenia Góra), in the terms, assortment, required packaging and quantities in accordance with the current needs of the Contracting Authority. 5)The Contracting Authority will notify the authorized person indicated in the offer for contact by telephone of each delivery and will indicate the ordered products with the quantity, by 14:00 on the day preceding the delivery day. The order will be sent from the email address: [email protected]. 6)Implementation of the order is mandatory on the next day from the placement of the order between 08:00 and 10:00 (unless a different delivery time is indicated in the order). 7)Delivery of ordered goods to the Contracting Authority's premises with delivery guarantee from Monday to Saturday (if necessary). 8)In the event of a complaint about the quality and quantity of the delivered goods, the Contractor is obliged to deliver a new batch to the Contracting Authority's premises, within the time declared in the offer, not longer than 2 hours (element of the criteria for evaluating offers – the possibility of shortening this period). 9)In the event of non-delivery on the given day and time of the part of the assortment ordered (not meeting the requirement indicated in the SWZ and the contract), the Contracting Authority reserves the right to purchase the goods immediately from another supplier, and if the purchase price is higher than that offered in the submitted offer of the Contractor, on the basis of which the Contracting Authority was selected to implement the order, the Contracting Authority will charge the Contractor with the difference in the purchase price by deducting the calculated amount of the purchase price difference from the nearest invoice of the Contractor. Such a type of deduction does not require the Contractor's consent. 10)The supplied food items must meet the requirements set out in the SWZ and the contract, including: a) meet the quality requirements described in the individual Tables, b) meet the required type and size of packaging, c) be marked in accordance with the requirements of the Minister of Agriculture and Rural Development Regulation of 23 December 2014 on the marking of foodstuffs (Journal of Laws of 2015 item 29), including in particular, each package must have a label with the following data: • have the name and address of the producer or importer with information about the country of origin, • have the name and type of product, class/species, for articles for which this is particularly required by the Tables, • have the best before date (dd/mm/yyyy), • have the net weight, • have a list of ingredients according to the share of raw materials, • be delivered in their initial warranty period, • have ensured proper transport and storage of the assortment, in accordance with sanitary and epidemiological requirements, especially in terms of ensuring the cooling of food items, in a way that ensures their proper commercial quality (in particular: nutritional, taste, organoleptic). 11)The Contractor is obliged to maintain the continuity of supplies in a crisis situation and in the event of the militarization of the unit in the country or region. 12)The Contracting Authority allows the possibility of submitting partial offers for one or more of the contract parts listed in this specification – tasks (parts from 1 to 10). 13)Requirements regarding the warranty. The validity periods of the food products of the producer (supplier) apply. The quality warranty period does not constitute a criterion for evaluating offers. 14)Information on the possibility of the Contractor entrusting the execution of part of the contract to subcontractors: The Contracting Authority does not introduce a reservation indicating the obligation for the Contractor to personally perform the key parts of the contract. The Contractor may entrust the execution of part of the contract to a subcontractor. 15)Requirements for the Contractor: a)The Contractor is responsible for the quality and compliance with the technical and quality conditions described for the subject of the contract. b)Due diligence is required in the performance of the contract. c)Agreements and decisions regarding the execution of the order will be agreed by the Contracting Authority with the appointed representative of the Contractor. d)Indication by the Contractor of contact telephones and fax numbers, as well as other arrangements necessary for the smooth and timely execution of the order. e)The Contracting Authority does not bear responsibility for damages caused by the Contractor during the execution of the subject of the contract. f)Place of execution of the order; the indicated food warehouse in the building of SP ZOZ Sanatorium Uzdrowiskowe MSWiA „Agat” in Jelenia Góra at ul. Cervi 14. g)The Contracting Authority does not require the submission of evidential means. 16)The detailed scope of deliveries is contained in the contract documents (Specification of Contract Conditions and its Appendices) and on the procedure page.
