Description

The subject of the contract is: the service of 24-hour physical protection of BP AMW. 2. The subject procedure in the fields of defence and security is a two-stage procedure: Stage I: In response to the contract notice, the Contractor submits an application for admission to the procedure (hereinafter: application) together with the documents referred to in Section VIII of the OWU. All the information necessary for the Contractors at this stage of the procedure has been included in the subject OWU and the contract notice, which has been published on the website of the procedure being conducted (procurement platform Marketplanet). The Contracting Authority will examine and evaluate the applications submitted in the subject procedure. The Contracting Authority will invite those Contractors whose applications for admission to the procedure will not be subject to rejection to submit tenders. In accordance with Article 411(2) of the Act, together with the invitation to submit tenders, the Contractors will be provided with the Specification of Contract Conditions (SWZ) together with the annexes. Stage II: In response to the invitation to submit a tender, the Contractor submits a tender. The Contracting Authority will examine and evaluate the tenders submitted in the subject procedure and will select the most advantageous tender. 3. The commencement of the implementation of the subject of the contract will take place no earlier than 10:00 on 01.02.2027. The Contractor is obliged to implement the subject of the contract for 24 months from the date of commencement of the implementation of the subject of the contract or until the maximum remuneration of the Contractor, specified in the concluded contract, is exhausted. 4. In accordance with Article 121 of the Act, the Contracting Authority reserves the obligation for the Contractor to personally perform the key task related to the subject service, i.e. having its own intervention group in the sense of § 1 point 3 of the Regulation of the Minister of the Interior and Administration of 21 October 2011 on the rules of arming specialist armed protective formations and the conditions of storage and registration of weapons and ammunition (Journal of Laws of 2015, item 992) and directing it to the implementation of the subject contract (during the implementation of the basic contract, renewal and option). 5. The Contracting Authority will assess the fulfilment of the conditions for participation in the procedure and the absence of grounds for exclusion of the Contractor from the procedure on the basis of an analysis of the documents and declarations submitted together with the application for admission to the procedure. The documents and declarations must unambiguously indicate that the Contractor meets the conditions and is not subject to exclusion. In accordance with Article 405(5) of the Act, the declaration referred to in Article 125(1) of the Act and the subject evidence must confirm the absence of grounds for exclusion and the fulfilment of the conditions for participation in the procedure no later than the date of submission of the applications for admission to the procedure. In the course of the examination and evaluation of the applications for admission to the procedure and the documents and declarations submitted, the Contracting Authority may, in particular, request the submission, correction or supplementation of documents or the submission of explanations of their content. The documents and explanations submitted at the request of the Contracting Authority must confirm the fulfilment of the conditions for participation in the procedure and the absence of grounds for exclusion no later than the date of submission of the applications for admission to the procedure. 6. In this procedure, communication between the Contracting Authority and the Contractors takes place through a postal operator in the sense of the Act of 23 November 2012 - Postal Law (Journal of Laws of 2026, item 558), hereinafter: the Postal Law Act, in person, through a courier or by means of electronic communication means in the sense of the Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws of 2024, item 1513), with the reservation of the provisions of Sections XII and XIII of the Description of the Conditions of Participation, published on the website of the procedure being conducted together with this notice. Each of the parties, at the request of the other, will immediately confirm the fact of receiving an e-mail. The submission of applications for admission to the procedure takes place through a postal operator in the sense of the Postal Law Act, in person or through a courier. All questions regarding the procedure being conducted should be submitted using the Contracting Authority's procurement platform Marketplanet, hereinafter referred to as the Platform or Procurement Platform, (direct link to the procedure: https://amw.ezamawiajacy.pl/pn/AMW/demand/296449/notice/public/details or sent to the e-mail address: [email protected], with the subject „Procedure no. BP-DZP.2611.1.2026”. 7. If explanations of the content of the OWU are necessary for the proper preparation and submission of an application for admission to the procedure, the Contracting Authority will provide explanations in this regard immediately, but no later than 6 days before the expiry of the deadline for submitting applications, provided that the request for explanations of the content of the OWU was received by the Contracting Authority no later than 14 days before the expiry of the deadline for submitting applications for admission to the procedure. In the event that the request for explanations of the content of the OWU was not received within the time limit referred to in the preceding sentence, the Contracting Authority is not obliged to provide explanations of the content of the OWU. The extension of the deadline for submitting applications for admission to the procedure does not affect the deadline for submitting applications for the provision of explanations of the content of the OWU. 8. The subject contract is related to access to non-public information under the clause "Restricted". 9. In accordance with Article 1(3) of the Act of 5 August 2025 on the certification of contractors of public contracts (Journal of Laws of 2025, item 1235 as amended), the provisions of the Act on the certification of contractors do not apply to the awarding of public contracts in the fields of defence and security in the sense of Article 7 point 36 of the Public Procurement Law.
