Poland – Repair and maintenance services of rolling stock – Naprawa P4 EZT serii EN57-1920 II

The subject of the contract is the execution of maintenance level P4 repairs to the electric traction set (ETS) series EN57-1920. 2. As part of the subject of the contract, the Contractor will carry out the modernization of the toilet and monitoring system as well as additional works. 3. In all records of SWZ and its annexes, which refer to standards, technical assessments, technical specifications and technical reference systems, in accordance with Article 101(4) of the Pzp Act, the Purchaser allows the application of solutions equivalent to those described in the standards, technical assessments, technical specifications and technical reference systems indicated in the SWZ and annexes if they allow to obtain features or parameters no worse than those referred to in the SWZ and annexes. In the event of the application of equivalent solutions, the Contractor is obliged to prove in writing the equivalence of the offered technical parameters in relation to the subject of the contract. The Contractor will demonstrate in the offer, in particular by means of the subject evidence, referred to in Articles 104-107 of the Pzp Act, that the proposed solutions meet the requirements specified in the description of the subject of the contract to an equivalent extent. 4. The Purchaser requires the submission of the subject evidence, referred to in paragraph 3 (if applicable). If the Contractor does not submit the subject evidence or the submitted subject evidence is incomplete, the Purchaser, in accordance with the provisions of Article 107(2) of the Pzp Act, will call for the submission or supplementation of the subject evidence, referred to in paragraph 3 (if applicable). 5. If the Contractor intends to invoke an official certificate, referred to in the Act of 5 August 2025 on the certification of public procurement contractors, he is obliged to indicate this in Part II, Section A of the JEDZ, providing: the number and designation of the certificate, the full name of the certifying body that issued the document, the validity period of the certificate and the exact scope of the exclusion or participation conditions, in relation to which the Contractor invokes this certificate. 6. The detailed description, scope, requirements and method of implementation of the contract have been specified in the Draft Contract Terms constituting Annex No. 1 to the SWZ.
