Poland – Antineoplastic agents – Dostawa środków przeciwnowotworowych w podziale na 15 części.

The subject of the contract is the delivery of anti-cancer drugs in 15 lots. The subject evidence required to demonstrate the lack of grounds for exclusion from participation in the procedure, submitted by the contractor whose offer has been highest rated, upon the Contracting Authority’s request (within a deadline set by the Contracting Authority, no shorter than 10 days): 1) Information from the National Criminal Register in the scope specified in: a) Article 108(1)(1) and (2) of the Public Procurement Law (PZP), b) Article 108(1)(4) of the PZP, regarding a court order prohibiting participation in public procurement proceedings as a criminal penalty, – issued no earlier than 6 months before its submission. 2) A declaration by the Contractor, in the scope of Article 108(1)(5) of the PZP, of not belonging to the same capital group, within the meaning of the Act of 16 February 2007 on the protection of competition and consumers (Journal of Laws of 2023, item 1689), with another contractor who submitted a separate offer, or a declaration by the Contractor of belonging to the same capital group together with documents or information confirming the preparation of the offer independently of another Contractor belonging to the same capital group. 3) A certificate from the competent tax office head confirming that the Contractor is not in arrears with tax and fee payments, in the scope of Article 109(1)(1) of the PZP, issued no earlier than 3 months before its submission, and in the case of arrears with tax or fee payments – together with the certificate the Contractor is obliged to submit documents confirming that before the deadline for submitting offers the Contractor made the payment of the due taxes or fees together with interest or penalties or concluded a binding agreement regarding the repayment of these liabilities. 4) A certificate or other document from the competent territorial unit of ZUS or the competent regional branch or the competent territorial unit of the Agricultural Social Insurance Fund confirming that the Contractor is not in arrears with social and health insurance contributions, in the scope of Article 109(1)(1) of the PZP, issued no earlier than 3 months before its submission, and in the case of arrears with social or health insurance contributions – together with the certificate or other document the Contractor is obliged to submit documents confirming that before the deadline for submitting offers the Contractor made the payment of the due social or health insurance contributions together with interest or penalties or concluded a binding agreement regarding the repayment of these liabilities. 5) An extract or information from the National Court Register or from the Central Information and Business Activity Register, in the scope of Article 109(1)(4) of the PZP, issued no earlier than 3 months before its submission, if separate provisions require registration in the register or record. 6) If the Contractor has its registered office or place of residence outside the territory of the Republic of Poland, instead of the documents referred to in Section VI, Part A, Article 3 of the SWZ: a) point 1 – submits information from the appropriate register, such as the commercial register, or, in the absence of such a register, another equivalent document issued by the competent judicial or administrative authority of the country in which the contractor has its registered office or place of residence or the place of residence of the person to whom the information or document relates, in the scope referred to in Section VI, Part A, Article 3(1) of the SWZ, issued no earlier than 6 months before its submission; b) points 3, 4, 5 – submits a document or documents issued in the country in which the Contractor has its registered office or place of residence, confirming respectively, that: — it has not breached obligations related to the payment of taxes, fees, or social or health insurance contributions, — its liquidation has not been initiated, bankruptcy has not been declared, its assets are not managed by a liquidator or a court, it has not concluded an agreement with creditors, its business activity is not suspended or it is not in a similar situation resulting from a similar procedure provided for in the provisions of the place where this procedure was initiated; — issued no earlier than 3 months before their submission. 7) If in the country in which the Contractor has its registered office or place of residence or the place of residence of the person to whom the document relates, the documents referred to in point 7) are not issued, or if these documents do not relate to all the cases referred to in Article 108(1)(1), (2) and (4), Article 109(1)(1) of the PZP, they are replaced respectively in whole or in part with a document containing respectively a declaration by the Contractor, indicating the person or persons authorised to represent it, or a declaration by the person to whom the document was to relate, submitted under oath, or, if in the country in which the Contractor has its registered office or place of residence or the place of residence of the person to whom the document was to relate, there are no provisions on a declaration under oath, submitted before a judicial or administrative authority, a notary, a professional or economic self-government body, competent in respect of the registered office or place of residence of the contractor or the place of residence of the person to whom the document was to relate. The deadlines for issuing documents and declarations, referred to in the preceding sentence, shall be applied respectively the deadlines referred to above in point 6 lit. a – b above. 8) The documents referred to above in Section VI, Part A, Article 3 are submitted by each of the Contractors jointly applying for the award of the contract. The Contractor may replace the documents indicated in points 2 and 3 above with a certificate of public procurement contractor, if the scope of certification confirms the fulfilment of the condition of participation in the procedure and the absence of grounds for exclusion, which were specified by the Contracting Authority. In the event of the submission of the certificate, the Contracting Authority will assess it in terms of the scope of certification, currency and compliance with the requirements specified in the SWZ. In the scope not covered by the certificate, the contractor is obliged to submit the subject evidence required by the Contracting Authority.
