The present notice serves to conclude pharmaceutical rebate contracts pursuant to §§ 130a para. 8 or 130c para. 1 SGB. This is not an award of public contracts within the meaning of Directive 2014/24/EU or §§ 97 et seq. GWB. Any pharmaceutical company pursuant to § 4 para. 18 AMG may become a contracting partner. According to the case law of the ECJ, such licensing procedures are not necessarily subject to public procurement law, as no competition takes place due to the absence of a selection decision. The notice serves as an invitation to conclude rebate contracts with conditions that are equally applicable to all contracting partners and non-dispositive, including the determination of the rebate. The contract is concluded by signing the contractual documents and submitting the required declarations, which can be requested from the designated contact point.
