The subject of the contract is the equipment of the Cystic Fibrosis Centre for children in Dziekanów Leśny. The contract is divided into 2 following lots: Lot 1 - Device for neutral gas flushing with integration with the hospital's information system 1 unit. Lot 2 - Device for assessing the performance of the respiratory system with integration with the hospital's information system. 1 unit. 2. The contracting authority allows for the submission of partial offers. 3. The detailed description of the subject of the contract contains Annex No. 2a to SWZ - Description of the subject of the contract (OPZ), Annex No. 2b to SWZ - Set of technical parameters, Annex No. 2 to SWZ - Price list form and Annex No. 7 to SWZ - Contract draft. 4. The contractor may submit an offer for one or more parts of the contract. The contracting authority does not limit the number of contract parts that can be awarded to one contractor. The contract is divided into 2 lots/parts/tasks. 5. The subject of the contract must be new, unused and have a CE marking as well as current documents allowing it to be placed on the market and used in the territory of the Republic of Poland, in accordance with the provisions of the Act of 7 April 2022 on medical devices. 6. The procedure for awarding this contract has been classified as supplies. 7. The contracting authority envisages the application of the so-called reverse procedure, as referred to in Article 139(1) of the Pzp Act, i.e. the contracting authority first carries out an examination and evaluation of the offers, and then qualifies the contractor whose offer was highest rated, in terms of lack of grounds for exclusion and meeting the conditions for participation in the procedure. 8. The contracting authority applies Article 138(4) of the Pzp Act, because the submission of offers takes place entirely using electronic communication means. 9. The subject of the contract is carried out within the framework of contract No. FEMA 05.06-IP.01-06IH/24-00 for the co-financing of the non-competitive project: "Equipment of the Cystic Fibrosis Centre for children in Dziekanów Leśny" co-financed from the European Regional Development Fund within the Priority: V: "European Funds for a better quality of life in Mazovia" Actions: 5.6: "Health Protection" of the Programme European Funds for Mazovia 2021-2027. 10. In accordance with Article 257 of the Pzp, the contracting authority may invalidate the contract award procedure if the public funds that the contracting authority intended to allocate for the financing of all or part of the contract have not been granted to it, and the possibility of invalidating the procedure on this basis has been provided for in the contract notice - in the procedure conducted in the open unrestricted tendering procedure.
