Germany – Public road transport services – Vergabe von Personenbeförderungsleistungen im Linienverkehr mit Kraftfahrzeugen in dem Landkreis Böblingen, Verkehrsraum Linienbündel BB03 "Nördliches Heckengäu"

The contracting authority is the competent transport authority in public local transport (ÖPNV) pursuant to § 8 Abs. 3 Satz 1 PBefG in conjunction with § 6 Abs. 1 of the Law on the Planning, Organisation and Design of Public Local Transport in Baden-Württemberg (ÖPNVG BW). The contracting authority is therefore also the competent authority within the meaning of EU Regulation (EC) No 1370/2007 (Regulation 1370/2007) pursuant to § 6 Abs. 3 ÖPNVG BW. The district is therefore responsible for ensuring an adequate transport offer in its area of responsibility (§ 8 Abs. 3 PBefG). Since the current transport service in the line bundle BB03 ends on 30.06.2027, the transport service must be guaranteed from 01.07.2027 and thus put out to tender again. The bus transport services on the following listed VVS lines are to be awarded: - Line 636 Weissach - Flacht - Perouse - Rutesheim - Renningen - Line 637 Renningen Süd - Bf - Robert-Bosch-Campus - Malmsheim (- Rutesheim) The above-mentioned bus transport services are line services which are to be approved pursuant to § 42 PBefG. The contractor must fulfil the specified timetable; this is attached in Annex LB.1. Annex LB.2 and Annex LB.3 contain the relevant planning aids. It should be noted that an option on line 637 is to be put out to tender. The option offers additional journeys between Renningen station and the Robert-Bosch-Campus. In the course of the commissioning of the Stuttgart 21 railway infrastructure project (S21), there may be shifts in the S-Bahn and/or regional transport. Deutsche Bahn announced a phased commissioning starting from approx. December 2031 in June 2026. Therefore, the specified bus timetables must be checked by the contractor for compatibility with the then applicable S-Bahn and/or regional transport timetables after the conversion of the S-Bahn and/or regional transport. Possible adjustments must be coordinated and implemented with the transport authority and, if necessary, the VVS in good time. The transport authority has the final decision-making power. The contracting authority makes it clear that the described mechanism constitutes options within the meaning of § 132 Abs. 2 S. 1 No. 1 GWB, which in the event of a, possibly later, commissioning of S 21, enable a change of contract without a new tender. The award of the contract falls within the scope of Directive 2009/33/EC of the European Parliament and of the Council (Directive on the promotion of clean vehicles — CVD).
