The subject of the contract is the service of renting buses with a driver for 31 BLT. The service aims to transport soldiers for the needs of 31 Baza Lotnictwa Taktycznego and military units being supplied for training, ranges, securing military ceremonies, military task forces, and briefings. By the term "bus", the Contracting Authority understands a motor vehicle transporting up to 45 people, but not less than 30. 2. The planned (forecasted) number of kilometres to be realised during the contract period is 60,000 km – 120,000 km. The places of commencement of the transport task will be the following localities: LESZNO, ŚREM, POZNAŃ (the transport of persons will mainly take place from m. Leszno/Śrem, ad hoc according to the needs of the Contracting Authority). In the contract, the Contracting Authority will specify: the place and time of bus (buses) delivery, the route and the number of persons transported 4. The service can be provided at any time of the day and night, as well as on days off and holidays. The service is ordered on the basis of each individual service order. The right to order a bus/buses is reserved for 2 days before the start of the service provision, and in exceptional situations for 24 hours before departure; as well as to cancel or change the previously agreed transport 12 hours before the start of the service provision. The number of buses ordered can range from 1 to 5 at a time (to ensure the transport of up to 220 soldiers simultaneously). 6. The Contractor and the Subcontractor undertake to employ, on the basis of an employment contract in accordance with the provisions of the Act of 26 June 1974 – the Labour Code, bus drivers who will perform the service. The Contracting Authority will annul the procedure for awarding the contract if the funds from the budget, which the Contracting Authority intended to allocate for the financing of the whole or part of the contract, have not been granted to it. The Contracting Authority will require the submission of a SINGLE EUROPEAN ORDER DOCUMENT confirming compliance with the conditions of participation in the procedure and the absence of grounds for exclusion on the day of submission of the offers exclusively from the contractor, whose offer was the highest rated – prepared in accordance with the template constituting Annex No. 2 to SWZ. The document should be signed with a qualified electronic signature. The contractor places information about the certificate in part II section A, in the field concerning the entry in the official register of approved contractors or possession of an equivalent certificate. The contractor should provide data enabling: •identification of the certificate; •determination of the certifying body; •location of the certificate in the database; •determination of the scope in which the contractor intends to use it. Each of the contractors jointly applying for the contract submits the document. In such a case, the JEDZ confirms the absence of grounds for exclusion of the Contractor and compliance with the conditions of participation in the procedure in the scope in which each of the Contractors demonstrates compliance with the conditions of participation in the procedure. After evaluating the offers, the Contracting Authority will call the Contractor, whose offer was the highest rated, to submit the following personal evidentiary means, 2.1. To confirm the absence of grounds for exclusion: 2.1.1INFORMATION FROM THE NATIONAL CRIMINAL REGISTER in the scope of: - art. 108 para. 1 point 1 and 2 of the Pzp Act, - art. 108 para. 1 point 4 of the Pzp Act, regarding a final judgment prohibiting participation in public procurement as a criminal measure, prepared no earlier than 6 months before its submission. 2.1.2DECLARATIONS OF THE CONTRACTOR, in the scope of art. 108 para. 1 point 5 of the Pzp Act, ON THE LACK OF BELONGING TO THE SAME CAPITAL GROUP in the meaning of the Act of 16 February 2007 on the protection of competition and consumers, with another contractor who submitted a separate offer, a partial offer or an application for admission to participate in the procedure, or a declaration of belonging to the same capital group together with documents or information confirming the preparation of the offer, partial offer or application for admission to participate in the procedure independently of another contractor belonging to the same capital group – prepared in accordance with the template constituting Annex No. 3 to SWZ. 2.1.3DECLARATIONS of the contractor on the currency of the information contained in the declaration, referred to in art. 125 para. 1 of the Pzp Act (JEDZ), in the scope of the grounds for exclusion from the procedure indicated by the contracting authority, referred to in: 1)art. 108 para. 1 point 3 of the Pzp Act, 2)art. 108 para. 1 point 4 of the Pzp Act, regarding a final judgment prohibiting participation in public procurement as a preventive measure, 3)art. 108 para. 1 point 5 of the Pzp Act, regarding concluding agreements with other contractors aimed at disrupting competition, 4)art. 108 para. 1 point 6 of the Pzp Act, in accordance with the template constituting Annex No. 5 to SWZ. 2.1.4. DECLARATION of the contractor applying for the award of the contract REGARDING THE EXCLUSION CLAUSES FROM ART. 5K OF REGULATION 833/2014 AND ART. 7 PARA. 1 OF THE ACT on special solutions in the field of counteracting the support of aggression on Ukraine and serving the protection of national security submitted on the basis of art. 125 para. 1 of the Pzp Act, which the Contracting Authority provided for in Chapter VII point 5 SWZ, in accordance with the template constituting Annex No. 6 to SWZ. 3.Personal evidentiary means indicated in point 2.1 may be replaced by a valid certificate of the contractor of public contracts, referred to in art. 124 para. 2 of the Pzp Act, exclusively in the scope in which the certificate confirms the absence of grounds for exclusion or compliance with the conditions of participation in the procedure in the scope corresponding to the requirements specified in the SWZ.
