Poland – Antineoplastic and immunomodulating agents – Dostawy produktów leczniczych stosowanych w programach lekowych i chemioterapii

The subject of the contract is the successive delivery of medicinal products used in therapeutic and chemotherapy programs for SPZOZ WSS No. 3 in Rybnik. The delivery specification is contained in Annex No. 1.1. to the Specification of Contract Terms (“Price Form”). The remaining contract terms are specified in Annex No. 2 to the Specification of Contract Terms, i.e. “Draft Contract Clauses”, which will be incorporated into the contract /contract clauses. Contracts for the resolved packages will be concluded after the completion of the current procedure with a validity period until 31.12.2027. The contracting authority allows for the submission of partial offers, and therefore the subject of the contract is divided into 13 parts (packages). The contractor may submit an offer for one or more parts of the contract (packages). The contracting authority does not limit the number of contract parts that can be awarded to one contractor. The contracting authority does not provide for the allocation of individual positions from the packages established in the SWZ during the tender procedure. The contracting authority does not allow the submission of offers for randomly selected positions in a given part (package). In the individual parts, the full assortment must be priced in the quantities specified by the contracting authority. Offers not containing the full scope of the contract subject will be rejected - if applicable. The contracting authority informs that, in accordance with art. 139 of the Pzp Act, it will first carry out an examination and evaluation of the offers, and then a subjective qualification of the contractor, whose offer was the highest evaluated in a given package, in terms of the lack of grounds for exclusion and the fulfillment of the conditions for participation in the procedure. In fulfilling the obligation arising from art. 24, para. 6 of the Act of 14 June 2024 on the protection of whistleblowers, the contracting authority informs that in the Samodzielny Publiczny Zakład Opieki Zdrowotnej Wojewódzkim Szpitalu Specjalistycznym No. 3 in Rybnik, a procedure for internal notifications of legal violations and subsequent actions has been adopted.
