Support in the development of the "Waste Management Plan - Sub-plan for the areas of municipal waste as well as construction and demolition waste"

Introduction/Background

Waste management plans serve as a central planning basis for the federal states to ensure disposal security and to implement the waste hierarchy. They contain, among other things, information on legal bases as well as on the type, quantity, origin and disposal of waste. They represent the disposal structure and underlying guiding principles and name goals and measures to promote the waste hierarchy, in particular waste prevention, preparation for reuse and recycling. In addition, waste management plans forecast waste quantities for a period of at least ten years and the existing facilities are compared with the future demand. The current "Waste Management Plan - Sub-plan (WMP - SP) Municipal Waste" of the state of North Rhine-Westphalia was published in the Ministerial Gazette in April 2016 and was adapted in March 2023 by a Technical Supplement to new requirements of the EU Waste Framework Directive (WFD) for waste management plans. Since several contents of the "WMP - SP Municipal Waste" are no longer up-to-date, this is now to be updated for the planning period until 2038. The SP Municipal Waste is to be supplemented by the area of construction and demolition waste, so that an integrated sub-plan for the areas of municipal waste as well as construction and demolition waste is created.

Goals

With the creation of the "WMP - SP Municipal Waste as well as Construction and Demolition Waste", the disposal security in NRW is to be ensured, documented and the implementation of the waste hierarchy is to be strengthened. Provisions for the creation of waste management plans are contained in the German Circular Economy Act (KrWG) and the North Rhine-Westphalia Circular Economy Act (LKrWG). According to § 30 KrWG, waste management plans must, among other things, represent the following aspects:

- Goals of waste prevention, waste utilisation, in particular preparation for reuse and recycling, as well as waste disposal,

- Measures taken to prevent waste and the current situation of waste management,

- Necessary measures to improve waste utilisation and waste disposal, including an assessment of the measures with regard to their suitability for achieving the goals, and

- Waste disposal facilities that are necessary to ensure the disposal of waste as well as the utilisation of mixed waste from private households, including those that are also collected in other areas of origin.

In addition, a forecast must be created with regard to the expected developments of the waste generated and the future demand for waste disposal facilities in NRW for a period of at least ten years. Furthermore, waste management plans must contain measures to combat and prevent any form of littering as well as to clean up the environment from waste of any kind. In addition, waste management plans must contain suitable qualitative and quantitative indicators and targets with regard to

a) the quantity of waste generated and its treatment and

b) the municipal waste that is energetically utilised or disposed of.

An overview of all required contents of waste management plans can also be found in § 30 KrWG. In the creation of waste management plans, according to § 31 KrWG, the municipalities and the districts as well as their respective associations and the public law waste disposal companies are to be involved. Furthermore, the waste management plans are to be coordinated between the federal states and the public is to be involved according to § 32 KrWG. Within the scope of this order, the Ministry for the Environment, Nature Conservation and Transport of the State of North Rhine-Westphalia (MUNV) is to be supported in the development of certain contents of the "WMP - SP Municipal Waste as well as Construction and Demolition Waste" and in the implementation of the participation procedure.
