Poland – Ferry transport services – Świadczenie usług przewozowych promami przez Odrę w województwie lubuskim: ZADANIE NR 1 , ZADANIE NR 2, ZADANIE NR 3

1) The subject of the contract (applies to all tasks): Inter-embankment ferry transport of mechanically propelled vehicles and passengers at times established in the schedule constituting Annex 1-3 to the Subject of the Contract for individual ferry crossings. The detailed description of the subject of the contract and the technical requirements are specified in Section III of the SWZ. 2) Right of option (APPLIES TO TASKS 1 and 2) The Contracting Authority informs that it foresees the use of the right of option during the execution of the Contract, as referred to in Article 441 of the Public Procurement Law (consolidated text Journal of Laws of 2026, item 793). a) Scope of the basic contract and threshold values within the right of option (minimum/maximum) The material scope of the basic contract has been defined in the Subject of the Contract in Section III of the SWZ (separately for each task). By exercising the right of option, the Contracting Authority allows for the possibility of increasing the scope of the basic contract by additional quantities of services (works), for which the maximum size (quantity) within the right of option has been specified in the Subject of the Contract - right of option in Section III of the SWZ separately for each task; b) Place of performance of services covered by the right of option The place of performance of services covered by the right of option will be: Task 1: 1) Location of the crossing Odra River km 481,120, provincial road no. 281; locality Pomorsko 2) Operator Road Administration in Zielona Góra, Al. Niepodległości 32 Task 2: 1) Location of the crossing Odra River km 485,000, provincial road no. 280; locality Brody 2) Operator Road Administration in Zielona Góra, Al. Niepodległości 32 c) Grounds for exercising the right of option The grounds for exercising the right of option have been indicated in the Contract template. The Contracting Authority foresees the possibility of exercising the right of option in the following situations: - in the event of circumstances arising from economic grounds, identified during the execution of the contract, i.e. - the need to provide ferry transport services across the Odra in the event that the ferry crossing in Brody is not transferred to the municipality along with a section of provincial road no. 280. The above circumstances are independent of the Contracting Authority, and due to the dynamic nature of construction works, they may occur. - in the event of the need to extend the term for the performance of services specified in the subject of the contract, in quantities not exceeding the sizes given in this annex and subject to the availability of financial resources enabling the financing of this part of the contract. d) Term for the performance of services covered by the option The services covered by the right of option will be performed within the contract performance term, i.e. FOR ALL TASKS: by 31.12.2028. e) Initiation of the contract covered by the option The condition for initiating the contract covered by the option is the submission by the Contracting Authority of a written or electronic statement of intent to exercise the right of option for the next calendar month, in which case the Contractor is obligated to perform it. The statement referred to above will be submitted by the Contracting Authority cyclically, for each subsequent month, by the 20th day of the month preceding the month in which the service is to be performed under the option. The option is facultative, which means that in the event of the Contracting Authority not exercising the right of option, the Contractor is not entitled to claim performance of this scope of the contract. Failure to submit by the Contracting Authority a statement clearly expressing its will in this respect results in the Contractor being released from performing the optional contract. f) Remuneration of the Contractor The remuneration of the Contractor for services performed under the option will be calculated according to the rates indicated in the offer in the price form for the basic contract (analogously for individual scopes of services indicated in the subject of the contract - right of option) and the actual number of months performed under the option.
