The objective of the VBG (hereinafter also referred to as the "AG") is to award several cleaning services, divided into a total of 2 lots at one location, through a Europe-wide tender. The subject of the individual lots is both the maintenance cleaning (Lot 1) and the window and glass cleaning (Lot 2) for the AG at the location Berlin (District Administration), Markgrafenstraße 18 in 10969 Berlin. Both services will be awarded for the period from 01.01.2027 to 31.12.2028. A one-time contract extension option for both lots for a further 24 months is possible through a unilateral declaration by the AG as follows: Each extension option begins on 01.01.2029 and ends on 31.12.2030, without the need for termination. Each extension option requires written form and will be declared by the AG in writing to the contractor at the latest 4 months before the end of the respective regular term. An extension beyond 31.12.2030 is excluded. Nevertheless, in exceptional cases, a consensual short-term contract extension may occur if extraordinary and unforeseeable circumstances (e.g. the cancellation of a tender or construction-related delays) make this necessary. In both lots, the first six months of the contract period are considered a trial period. During this period, in particular, the quality management will be checked in practical implementation, the AG can terminate the contract within these first six months without giving reasons with a notice period of 14 days to the end of the calendar month. The termination requires written form. If the AG no longer operates the building or parts of the building (subletting), it can terminate the contract with a notice period of 4 weeks to the end of the calendar month in which the changes become effective. The right to terminate the contract for good cause as regulated in other statutory provisions remains unaffected. The contract periods end without the need for termination. A contract extension requires written form and will be announced four months before the end of the contract period. "Subsequent performer clause": The first six months of the contract period are considered a trial period. If it is determined by the AG during this period that the services of the awarded contractor (contractor) do not meet the requirements, the AG can terminate the contract within the trial period without giving reasons with a notice period of at least 14 days to the end of the calendar month. The termination requires written form. If the contract from this tendering procedure is terminated for a special reason, in particular also through insolvency or termination, during the trial period, the contracting authority reserves the right to commission the bidders ranked 2 and 3 from the completed tendering procedure for the remaining term. The subsequent performer clause will only be applied by the AG within the trial period. In this case, the commissioning would take place according to the offer and price conditions submitted within the framework of this tendering procedure upon written declaration by the bidder upon request by the contracting authority. If the subsequent performer clause does not come into force, the contracting authority will in this case carry out a new tendering of the services in question. It is therefore obvious that it will only make very restrained use of this right to extraordinary termination. It is therefore in no way to be expected that the contracting authority will declare an extraordinary termination completely without reason. The provisions of the German Civil Code (BGB) shall remain unaffected. A clarifying regulation that an extraordinary termination may possibly give rise to claims for damages is therefore not necessary. If, in the event of a termination of the contract of any kind, it comes to a termination of the contractual relationship with the awarded contractor during the contract period, in particular in the trial period, the AG has the possibility to commission the bidder ranked next in the completed tendering procedure for the remaining term at the latest 4 weeks before the end of the previous trial period. A prerequisite for the "subsequent performance" is, however, that the bidder ranked next submits an express written declaration of retroactive binding to his then submitted offer to the AG. The bidder ensures, after downloading the tender documents from www.dtvp.de, that they are complete. If the tender documents contain unclear regulations from the bidder's point of view or raise questions that can influence the creation of the offer, the contracting authority must be informed immediately via the communication function of the German E-Procurement Portal. Questions and hints regarding the tender documents and the subject of the contract are to be addressed exclusively to the contracting authority via the communication function of the German E-Procurement Portal. They are to be formulated in German. Bidders are requested to consider when formulating the questions that these, together with the answers, will be made available to all interested companies. If changes or additions result from this, they will become part of the tender documents. No telephone information will be given; if it is given, it will not be binding. Answers will be made available to all bidders who have downloaded the tender documents, simultaneously in anonymised form. All registered bidders will automatically receive a notification by e-mail via the German E-Procurement Portal. There is the possibility to inspect the object between 06.07.2026 and 17.07.2026.
