Poland – Refuse and waste related services – Odbiór, transport i zagospodarowanie odpadów komunalnych od właścicieli nieruchomości, na których zamieszkują mieszkańcy oraz z PSZOK- w Gminie Jerzmanowice-Przeginia od 01.01.2027 r. - 31.12.2027 r.

I. 1. The subject of the contract is the provision of the service entitled Collection, transport and disposal of municipal waste from property owners, where residents live, and from the Selective Waste Collection Point – in the Municipality of Jerzmanowice-Przeginia from 01.01.2027 to 31.12.2027. 2. The subject of the contract is specifically defined in the Subject of the Contract Description (OPZ) which is Annex 1 to the SWZ. 3. This procedure is subject to the right of option. The Contracting Authority, pursuant to Article 441 of the Pzp, foresees the possibility of exercising the right of option. 1) The application of the right of option means that the amount of waste forecasted in the OPZ may increase by 6%, increasing the gross remuneration of the Contractor, as defined in the Contract, by a maximum of 6%. 2) The rules and conditions for the application of the right of option are defined in the draft contract (Annex 5 to the SWZ). 3) The Contracting Authority may exercise the option, as it has provided for the option in the contract notice and in the contract documents in the form of clear, precise and unambiguous contractual provisions. II. DESCRIPTION OF THE METHOD OF PREPARATION OF THE OFFER AND FORMAL REQUIREMENTS FOR THE SUBMITTED EVIDENCE AND DOCUMENTS 1. The Contractor may submit only one offer. 2. The content of the offer must correspond to the content of the SWZ. 3. The offer is prepared in Polish on the Offer Form - in accordance with Annex 2 to the SWZ. Together with the offer, the Contractor is obliged to submit: 1) a declaration in the form of the European Single Procurement Document (ESPD), as referred to in Section IX, 1 of the SWZ; 2) a commitment of another entity and a declaration in the form of the European Single Procurement Document (ESPD) (if applicable); 3) relevant evidential means; 4) a declaration of the Contractor/Contractors jointly applying for the award of the contract regarding the grounds for exclusion under Article 5k of Regulation 833/2014 and Article 7(1) of the Act on specific solutions in the field of counteracting the support of aggression against Ukraine and serving to protect national security – Annex 9A to the SWZ. 5) declarations of the entity providing resources regarding the grounds for exclusion under Article 5k of Regulation 833/2014 and Article 7(1) of the Act on specific solutions in the field of counteracting the support of aggression against Ukraine and serving to protect national security – Annex 9B to the SWZ. 6) proof of the deposit (in the case of a deposit made in the form of a guarantee or bond); 7) documents from which the right to sign the offer results, i.e. a copy or information from the National Court Register, Central Information and Business Activity Register, appropriate powers of attorney (if applicable). 4. The offer and other declarations and documents, for which the Contracting Authority has specified templates in the form of forms attached to the SWZ, should be prepared in accordance with these templates. 5. In the event that the offer has not been signed by a person authorised to represent the Contractor specified in the relevant register or other document appropriate for the given organisational form of the Contractor, the offer should be accompanied by a power of attorney, submitted in electronic form, endorsed with a qualified electronic signature or an electronic copy, authenticated by a qualified electronic signature by a notary. 6. The offer, including the European Single Procurement Document (ESPD), must be prepared, on pain of invalidity, in electronic form (signed with a qualified electronic signature). 7 The instruction for completing the single document is Annex 4 to the SWZ. 8. Additionally, together with the declaration in the form of the ESPD, the Contractor is obliged to submit a declaration on paper constituting Annex 9A to the SWZ - template of the Contractor's declaration of non-exclusion in connection with counteracting aggression against Ukraine. 9. The Contracting Authority requires that the following evidential means be submitted with the offer: a) to confirm the marking of the vehicle in a visible place: with the company name, address details, telephone number of the Contractor – 3 photographs for each of the vehicles (including one with a view of the whole vehicle from the front) with a description of which vehicle the photograph relates to; b) to confirm the emission standard of the vehicle, the Contractor shall submit a document from which it will unambiguously result that the vehicle used by him for waste collection has the emission standard EURO 6 or equivalent. In particular, the Contractor may submit one of the documents, if it confirms the above emission standard: EURO Certificate, vehicle registration document, vehicle card, extract from the certificate of approval or copy of the decision exempting the vehicle from approval, producer's declaration or authorised representative of the producer, CE conformity document – a document issued by the vehicle manufacturer or its authorised representative, constituting a legally binding undertaking stating that the vehicle complies with the essential requirements of the relevant EU Directives together with a copy of the registration document with the same VIN number (possibility of unambiguous identification of the vehicle); c) to confirm that at least one vehicle adapted for the collection of municipal waste used by the Contractor for the purposes of implementing this contract is a vehicle powered by alternative fuels, the Contractor shall submit a document from which it will unambiguously result that the vehicle used meets the requirements arising from Article 68a and 68b of the Act of 11 January 2018 on electromobility and alternative fuels.
