Poland – Sewage, refuse, cleaning and environmental services – Odbiór i zagospodarowanie odpadów komunalnych z nieruchomości zamieszkałych na terenie Gminy Ciasna w 2027 r.

Collection and disposal of municipal waste from properties located in the territory of the Gmina Ciasna in 2027. The subject of the contract is the collection and disposal of municipal waste generated and collected from all properties where residents live, located within the administrative boundaries of the Gmina Ciasna. The scope of the contract includes the collection and disposal of the entire stream of municipal waste handed over by the owners of properties located in the aforementioned municipality, where residents live, in a manner that ensures the reduction of the mass of biodegradable municipal waste handed over for disposal as part of the assigned task. The detailed description of the subject of the contract (OPZ) is contained in Annex No. 6 to the SWZ. The contract must be completed from the date of the conclusion of the contract but not earlier than from 01.01.2027 to 31.12.2027, but no later than the day (inclusive), on which the remuneration of the Contractor for the performance of the contract reaches the total offer price for the minimum (guaranteed) quantity of waste, i.e. the amount specified in § 5 paragraph 2 of the contract, and in the case of the Contracting Authority exercising the option right until the moment when the remuneration for the performance of the subject of the contract reaches the value specified in § 5 paragraph 3 of the contract – the Contractor is obligated to provide the service of collecting and disposing of municipal waste generated in the territory of the Gmina Ciasna. (In the event of an extension of the tender procedure, the start date will be from the date of the conclusion of the contract.) Bearing in mind art. 436 point 1 of the Act, the Contracting Authority informs that the indication of the final date of performance of the contract results from the fact that the subject matter must be performed and settled in 2027. **NOTE:** Certification of public procurement contractors. 1) The Contractor may, instead of the appropriate substantive evidence required by the Contracting Authority in this procedure, submit a Certificate of public procurement contractors, as referred to in the Act of 5 August 2025 on the certification of public procurement contractors (Dz.U. of 2025 item 1235 as amended), if this certificate confirms the circumstances required by the Contracting Authority in the scope of meeting the conditions for participation in the procedure or indicate data enabling the Contracting Authority to obtain or verify the certificate independently, provided that the certificate confirms the circumstances required in this procedure. 2) Submitting or indicating a certificate is the right of the Contractor. The Contracting Authority does not require the possession of a certificate as a condition for participation in the procedure and does not make the possibility of applying for a contract dependent on the possession of certification. 3) The certificate replaces the appropriate substantive evidence only to the extent that it confirms the circumstances required by the Contracting Authority in this procedure from its content or from the data disclosed in the certification database. If the certificate covers only part of the conditions for participation in the procedure, the Contractor submits: a) the certificate – in the scope covered by the certification; b) the remaining required substantive evidence – in the scope not covered by the certification. 4) The certificate does not replace documents, declarations or information that do not constitute substantive evidence, in particular: a) the offer form; b) the power of attorney; c) documents or declarations regarding the content of the offer. 5) The Contracting Authority will verify the certificate using the database of certified public procurement contractors, in particular in the scope of: a) the consistency of the Contractor's data with the data indicated in the certificate; b) the validity of the certification; c) the absence of suspension of the validity of the certification; d) the scope of the certification; e) the consistency of the scope of the certification with the conditions for participation in the procedure specified in the SWZ. Certification of public procurement contractors also covers entities providing resources, if they wish to confirm in this way the absence of grounds for exclusion or their capabilities. The certificate does not replace the formal obligation of the entity providing resources required under art. 118 paragraph 3 of the Pzp Act – these documents are submitted separately. Documents of the Contractor having its registered office or place of residence outside Poland: 1. If the Contractor has its registered office or place of residence or the place of residence of the person to whom the information or document relates outside the territory of the Republic of Poland, instead of: 1) information from the National Criminal Register, in the scope specified in art. 108 paragraph 1 point 1, 2 and 4 of the Act - submits information from the appropriate register, such as the commercial register, or, in the absence of such a register, another equivalent document issued by the competent judicial or administrative body of the country in which the contractor has its registered office or place of residence; 2. The document referred to in paragraph 5.1. point 1 should be issued no earlier than 6 months before its submission. 3. If in the country where the Contractor has its registered office or place of residence outside Poland, documents referred to in paragraph 5.1. are not issued, or if these documents do not relate to all the cases referred to in art. 108 paragraph 1 point 1, 2 and 4 of the Act, they are replaced in whole or in part by a document containing an appropriate declaration of the contractor, indicating the person or persons authorised to represent him, or a declaration of the person to whom the document relates, submitted under oath, or, if in the country where the contractor has its registered office or place of residence there are no provisions on the declaration under oath, submitted before a judicial or administrative body, notary, professional or economic self-government body, competent in view of the registered office or place of residence of the contractor. The provision of paragraph 5.2. shall apply. **NOTE:** In the event that the Contractor indicates, in order to demonstrate compliance with the conditions for participation, a currency other than the Polish zloty (PLN), for the purpose of its conversion, the following will be used: - the average NBP exchange rate on the day of publication of the notice in the Official Journal of the European Union,
