Framework agreement for the procurement of medicines for the treatment of patients and inpatients at the Clinical Hospital of Infectious Diseases, Constanta. - FRAMEWORK AGREEMENT – with a validity period of 24 months from the date of award of the framework agreement. The purchaser reserves the right to unilaterally terminate the present contract/framework agreement/subsequent contract, by written notification, without any compensation, from the date of conclusion of the subsequent contracts, framework agreements concluded by the Ministry of Health, as the centralised procurement unit. In this case, the supplier has the right to claim only the payment corresponding to the part of the contract/framework agreement/subsequent contract fulfilled up to the date of the unilateral termination of the present contract. Subsequent contracts will be concluded monthly or quarterly with the economic operator ranked first, depending on the needs of the contracting authority and the available funds. In the event that the bidder ranked first cannot maintain the price or can no longer deliver the product (changes in the contractual conditions between this bidder and the manufacturer), then a subsequent contract will be concluded with the economic operator ranked second. In the event that this operator cannot maintain the price or can no longer deliver the product (changes in the contractual conditions between this bidder and the manufacturer), then a contract will be concluded with the operator ranked third. NO competition will be reopened with the signatories of the framework agreements.
