Poland – Road construction works – Rozbudowa drogi wojewódzkiej nr 559 w km 45+060 do km ok 46+730 w m. Maszewo Duże, gm. Stara Biała – nr postępowania 148/26

The subject of the contract is "Expansion of Voivodeship Road No. 559 from km 45+060 to km 46+730 in Maszewo Duże, Stara Biała Commune" – procedure no. 148/26. 2. The Detailed Description of the Contract Subject is in the Tender Documentation (Part IV SWZ), in the Scope of Works - available for viewing only (Part V SWZ) and in the Cost Estimate (in the scope of utilising destruct containing exceeded permissible limits of polycyclic aromatic hydrocarbons - Part VI SWZ). The Contractor is to calculate the value of the works based on the attached project documentation, based on the quantity of asphalt destruct scheduled for utilisation indicated in the OWU, detailed technical specifications, general conditions of the contract for the execution of construction works. 3. The Contractor is obligated to ensure, at their own cost, safe conditions for road and pedestrian traffic in the area of the works covered by the contract, based on the traffic organisation project, "for the construction period" prepared by and at the cost of the Contractor. The Contractor is obligated to update the project of permanent traffic organisation. 4. In the event that the contract subject description refers to trademarks, patents or origin, source or a particular process that characterises the product or services provided by a specific contractor, the Purchaser allows equivalent solutions. 5. In the event that the contract subject description refers to standards, European technical assessments, approvals, technical specifications and technical reference systems, the Purchaser allows equivalent solutions described. 6. The Contractor is obligated to transfer copyrights to photographic and film documentation, as mentioned in the general conditions of the contract for the execution of construction works. 7. The Purchaser envisages awarding contracts, as mentioned in art. 214 para. 1 point 7 of the PZP Act, for a total net value of 20,910,211.98 PLN. As part of a similar contract, the following works are envisaged to be carried out: - preparatory works, - greenery management works, - demolition works, - earthworks, - substructures, - installation of protective devices, - curbs, edgings, verges and pavements, - ground subsoil reinforcement, - road safety devices, - traffic organisation and BRD works, - finishing works, - stormwater and sanitary sewerage works, - water supply and pipeline works, - telecommunications industry works, - power industry works, - road lighting construction. The aforementioned works relate to the section on which the construction works will be carried out and/or adjacent sections. 8. The Contractor is obligated to have a Civil Liability (OC) Insurance Policy for damages caused during the contract execution period to third parties for the entire contract period and for a guarantee sum of not less than 20,000,000.00 PLN. 1) The Contractor is obligated to submit a copy of the aforementioned policy within 7 days from the date of contract signature. Provided that the insurance continuity is maintained, the Purchaser allows the possibility of presenting several policies during the contract period confirming the possession of OC insurance. 2) The Contractor is obligated to submit to the Purchaser a copy of the next policy within 7 days from the expiry date of the previous policy. If the Contractor fails to comply with the above, the Purchaser will charge the Contractor contractual penalties in the amount specified in the contract. 3) In the event of failure to submit the policy within 30 days from the date of contract signature, the Purchaser will have the right to withdraw from the contract. 9. Contract implementation period: 21 months from the date of contract signature, including: - 18 months from the date of contract signature – work completion deadline; - up to 21 months from the date of contract signature – contract subject implementation deadline. The Contractor is obligated to comply with the following set interim deadlines (milestones) for work execution and the sequence of their implementation: I Milestone – completion of works (confirmed by a partial work acceptance protocol) with a value of not less than 30% of the gross remuneration for the execution of the entire contract subject (excluding remuneration for the utilisation together with the transport of asphalt destruct containing exceeded permissible limits of polycyclic aromatic hydrocarbons) within no later than 8 months from the date of contract signature. II Milestone - completion of works (confirmed by a partial work acceptance protocol) with a value of not less than 60% of the gross remuneration for the execution of the entire contract subject (excluding remuneration for the utilisation together with the transport of asphalt destruct containing exceeded permissible limits of polycyclic aromatic hydrocarbons) within no later than 14 months from the date of contract signature. III Milestone - completion of 100% of works (confirmed by the Purchaser with a final work acceptance protocol without significant defects/flaws) within no later than the final work acceptance deadline. No later than the deadline of III Milestone, the Contractor is obligated to present to the Purchaser documents confirming the utilisation, in accordance with the applicable law, of asphalt destruct containing exceeded permissible limits of polycyclic aromatic hydrocarbons. The Purchaser, in accordance with the contract conditions, allows the possibility of changing the implementation deadlines of interim deadlines. For failure to meet the set interim milestone deadline, the Purchaser will have the right to charge contractual penalties in accordance with the contract. 10. The Purchaser envisages the application of the so-called reverse procedure, as mentioned in art. 139 para. 1 of the PZP Act. 11. In accordance with art. 257 of the PZP Act, the Purchaser envisages the possibility of invalidating the subject of the proceedings if the public funds that the Purchaser intended to allocate for the financing of the entire or part of the contract have not been granted.
