In accordance with point 4 of the SWZ 4.1. The subject of the contract is the maintenance and development support service for the application and database of the Anti-Flood Protection System. The description of the subject of the contract includes the scope of the service (number of man-hours) that the Contractor will be obliged to perform within the framework of the basic contract and the contract covered by the right of option. The Purchaser reserves the right not to use the contract covered by the right of option. 4.2. The detailed scope and the manner of implementation of the subject of the contract have been specified in: - Annex No. 1 to the SWZ - Description of the subject of the contract - Annex No. 2 to the SWZ - Draft contractual provisions. 4.3. The Purchaser requires that the offered services, including all ICT products, ICT services and ICT processes used to implement the contract, both as main elements and as components, service delivery environment elements or accompanying solutions, do not include: 4.3.1. ICT products, ICT services or ICT processes indicated in the recommendation referred to in Article 33(4) of the Act of 5 July 2018 on the national cybersecurity system, stating their negative impact on the fundamental interest of the security of the state; 4.3.2. an ICT product, the type of which has been determined in the decision on recognising the supplier as a high-risk supplier, referred to in Article 67b(15) of the Act of 5 July 2018 on the national cybersecurity system, or ICT services or ICT processes specified in that decision.
