The subject of the public contract is the supplier's obligation to deliver and subsequently implement technical and software means to expand the existing DWDM devices and to provide support services for them and for the existing technical and software means. A more detailed specification of the subject of the public contract is given in the draft contract, which forms Annex 1 of the tender documentation. Given that the procuring entity has fully integrated existing DWDM HW and SW means into its IS structure and the expansion of the transmission capacity between locations by 100 Gb cannot be carried out for compatibility reasons except by using the means that are the subject of this contract, and the transition to other HW and SW means would entail disproportionately high costs for the procuring entity, whether in the procurement of completely new DWDM devices (including existing means where replacement is not necessary), or in the necessary adjustment of all existing applications and systems that use these means, the procuring entity considers that in this case it is justified by the subject of the public contract itself to refer to a specific product, or to HW and SW means and support of a specific manufacturer, the procurement of which is the subject of this public contract. The procuring entity has not proceeded with the division of the public contract into parts, since the subject of the public contract forms one functional unit and is tendered in a time-related context. The procuring entity is in the position of a provider of a regulated service when awarding the public contract, and that is in the regime of higher obligations within the meaning of Act No. 264/2025 Sb., on cybersecurity, as amended, and its implementing regulations, where this fact is taken into account by the procuring entity in the tender conditions of this public contract.
