Belgium – Mobile telephones – Raamovereenkomst voor de aankoop van telefoons, accessoires en aanverwante diensten

The Police Zone Voorkempen, as a purchasing central authority in the sense of article 2, 6°, a) of the Law on Public Procurement of 17 June 2016, wishes to conclude a framework agreement for the purchase of mobile devices (GSM, smartphones, tablets) and accessories, where the contracting entities and/or their employees can order via an associated online ordering platform and where suitable professional services and after-sales service are provided, so that the contracting entities are relieved of the purchasing, delivery and service process of mobile devices and accessories. The offered solution includes, inter alia: - Provision of an online Choose Your Own Device platform, whereby the (employees of the) contracting entities can choose and purchase a mobile device (GSM/smartphone/tablet) and accessories at a competitive price (competitive prices that follow market prices), whereby part of the purchase amount is paid by the employer (fixed budget made available by the employer) and part by the employee if the purchase exceeds that budget; - Sale and delivery of mobile devices (GSM/smartphone/tablet): the tenderers draw up a list of telephones that can be delivered and supported (list of telephones offered), which must at least contain the telephones listed in the inventory in the specifications (basic package) and is limited to devices driven by Android and iOS. (based on this list, the contracting entities determine individually which telephones are actually offered to the employee within the online platform. - the offer can be limited upon request); - Sale and delivery of accessories: the tenderers draw up a list of accessories that can be delivered and supported for the telephones from the list of telephones offered (list of accessories offered). This must at least contain the telephones (basic package) listed in the specifications; - Service Level Agreement (SLA): suitable professional services and after-sales service for the mobile devices and accessories (including the mandatory option for insurance). This contract is a contract for deliveries in the sense of art. 2, 20° of the Law on Public Procurement. This is a framework agreement as referred to in art. 2, 35° of the Law on Public Procurement of 17 June 2016. The framework agreement will be concluded with one participant. The conclusion of an agreement does not give the service provider any right of exclusivity. During the term of this framework agreement, the Police Zone Voorkempen and any other contracting party to this framework agreement may have services (services/deliveries), identical or analogous to those described in the specifications, performed. The service provider may not claim any compensation in this regard. There is no obligation to purchase for buyers and no minimum purchases are guaranteed. The contracting authority informs the tenderers that all quantities mentioned in the contract documents are given for information only and in no way bind the contracting authority to a minimum order volume. The contractor can in no way claim a minimum number of orders, nor compensation for too few orders placed. The maximum estimated value of this contract is 700,000.00 euros.
