The subject of the contract is the supply of 5000 new brake pad sets of type Jurid 878 (J1492/J1493) drawing no. C105255/35B5X or equivalent, for use in 45WE series EMUs and Pesa Sundeck double-decker coaches. Equivalent brake pads must be approved for use in the aforementioned vehicle types and coaches, have identical functions and parameters, and their use must not require permission to operate 45WE series EMUs and Pesa Sundeck double-decker coaches. 2. One brake pad set consists of 2 (two) brake pads – right and left. 3. The purchaser requires that the subject of the contract has: 1) a UIC certificate, compliant with UIC 541-3 standard, issued for the offered brake pad type, 2) a technical drawing of the offered brake pad type, 3) a product card, including the basic technical parameters of the offered brake pads. 4. In all records of SWZ and its annexes, which refer to standards, technical assessments, technical specifications and technical reference systems, in accordance with Article 101(4) of the Pzp Act, the Purchaser allows the use of equivalent solutions, standards, technical assessments, technical specifications and technical reference systems indicated in SWZ and annexes if they allow to obtain features or parameters no worse than those referred to. In the case of using equivalent solutions, the Contractor is obliged to prove in writing the equivalence of the offered technical parameters in relation to the subject of the contract. The Contractor will prove in the offer, in particular by means of the evidential means referred to in Articles 104-107 of the Pzp Act, that the proposed solutions meet the requirements specified in the subject of the contract to an equivalent extent. 5. The Purchaser demands the submission of evidential means referred to in Section IV, paragraph 1, points 1)-3) of SWZ, in Section IV, paragraph 3 of SWZ (if applicable). If the Contractor does not submit evidential means or the submitted evidential means are incomplete, the Purchaser will, in accordance with the provisions of Article 107(2) of the Pzp Act, call on the Contractor to submit or supplement evidential means referred to in Section IV, paragraph 1, points 1)-3) of SWZ, in Section IV, paragraph 3 of SWZ (if applicable). 6. If the Contractor intends to invoke an official certificate, as referred to in the Act of 5 August 2025 on the certification of public procurement contractors, they are obliged to indicate this in Part II, Section A of the JEDZ, providing: the certificate number and designation, the full name of the certifying body that issued the document, the validity period of the certificate and the exact scope of the exclusion grounds or participation conditions, in relation to which the Contractor invokes this certificate.
