The subject of the contract is the successive purchase and delivery of medicines for drug programmes, cytostatics and medicines used in the RDTL procedure for the needs of the Buyer. The detailed description of the subject of the contract and the estimated quantities are included in Appendix No. 5 to the SWZ (Price List - Description of the Subject of the Contract) and in Appendix No. 4 to the SWZ (Draft Contract) - The subject of the contract has been divided into 41 parts, in accordance with Appendix No. 5 to the SWZ. Price List - Description of the Subject of the Contract. - The Buyer allows the submission of partial offers for any quantity of Packages listed in Appendix No. 5 to the SWZ – Price List - Description of the Subject of the Contract. However, the Buyer reserves the right to submit offers by the Contractor for the entire assortment in a given Package. - The offered medicinal products must have current marketing authorisations valid on the date of submission of the offer, issued by the Minister of Health or a marketing authorisation issued by the European Council or the European Commission in accordance with the Act of 6 September 2001 on Pharmaceutical Law (Dz.U.2025.750 t.j. ze zm.). - Medicines used in drug programmes or chemotherapy must be included in the Catalogue of Refunded Medicines, must have registered indications for use in the given medical procedure and must be defined in the description of the drug programme or in the list of chemotherapy. - Medicines in RDTL must have registered indications for use in the given medical procedure. - The Buyer requires the name, producer and EAN code of the medicinal products to be provided for the offered product. - The Buyer allows a change in quantity from units to packaging with the appropriate price recalculation. The Buyer agrees to a change in packaging size, with the proviso that the packaging size for oral forms such as tablets, syrups, etc., does not exceed double the packaging size, unless otherwise agreed for the specified individual position. In cases where a single unit package containing a different number of units (different weight) is offered than the quantity specified in the SWZ, the quantity must be recalculated to two decimal places according to arithmetic rounding. - The Buyer allows the submission of offers that are equivalent in terms of pharmaceutical and therapeutic properties, the criterion by which the Buyer assesses equivalence:
