Germany – Legal advisory services – Rechtsberatungsleistungen im Vergabe- und Baurecht im Rahmen des Wiederaufbaus

The Municipal Association of Altenahr, together with its constituent municipalities (VG Altenahr/VGA), intends to award legal advisory services in three lots, each to be provided over a period of 6 years (4 years base term; twice option to extend by 1 year each) on the basis of framework agreements. The procurement need arises from the flood disaster in the Ahr Valley in 2021, during which a large part of the built stock of the VG Altenahr was destroyed. Since then, extensive measures have been taken to eliminate the consequences. In this context, the VG Altenahr is currently in the planning and reconstruction phase after overcoming the acute phase. As part of this, a variety of buildings and other structures are to be restored. The VG Altenahr and the municipalities are public contracting authorities and are therefore bound to comply with national and European procurement law. The planning and construction services required for reconstruction must be tendered by the VG Altenahr in accordance with the applicable procurement law regulations. This tender is to procure the legal support of the necessary procurement procedures. In addition, a variety of construction and architectural law issues arise during the construction phase, for which the VGA requires legal advice. This construction-related legal advice is also procured with this tender. The subject of the tender in the three lots also includes the legal support of construction and planning tenders, as well as the construction-related legal advice, for the Mittelahr Wastewater Treatment Plant (AWWMA). The contracting authority in this respect is the VGA. The tenders will be accompanied by the tendering office of the VGA on behalf of the respective municipality. All the reconstruction projects are publicly funded, so the respective applicable funding conditions must also be observed within the framework of the tendering procedures and the construction phase. There is no restriction on services attributable to reconstruction. Three lots are formed.
