Description

The procurement procedure is for the creation of a Dynamic Purchasing System (hereinafter: DPS) for MÁV Személyszállítási Zrt. for a period of 60 months for the procurement of materials needed for building and facility maintenance and/or repair work. Any economic operator that meets the suitability conditions determined by the contracting authority may join the DPS at any time during its entire period, with the possibility of submitting a new participation declaration opening after the deadline for submitting the first participation declaration has expired, following the date of sending the summary of the evaluation of the participation declarations. The contracting authority, during the implementation of the DPS, based on the provisions of Section 107 (2) of the Public Procurement Act, shall make available to those submitting a valid participation declaration in the DPS, at the same time as sending the invitation to tender, the precise technical description and contractual conditions relating to the specific public procurements to be implemented in the system. In the second, tendering phase of the procedure, the contracting authority is entitled to determine the tendering deadline in the individual invitations to tender for at least 5 calendar days. The participant must declare in the participation declaration that they accept the tendering deadline of at least 5 calendar days. If all participants taken up in the DPS accept the provisions relating to the tendering deadline, then this is to be considered as the conclusion of an agreement according to Section 84 (6) of the Public Procurement Act and the contracting authority is entitled to determine a tendering deadline of at least 5 calendar days in all invitations to tender, with the tendering deadline being extendable in justified cases and in accordance with the rules of the Public Procurement Act. If any economic operator does not accept the above, the contracting authority must determine a tendering deadline of at least 10 calendar days, with this not preventing the contracting authority and participants from agreeing on a shorter period during the existence of the DPS. In the second, tendering phase of the procedure, the participant/tenderer must submit the further documents and declarations specified in the procurement documents and technical description issued in the tendering phase, as well as those prescribed by the Public Procurement Act or the relevant legal provisions. The participant must declare for the validity of the participation declaration that they accept the general contractual conditions issued by the contracting authority as part of the other procurement documents of the invitation to participate. Following the successful completion of the participation phase of this procedure, upon the emergence of a specific procurement need, the contracting authority sends the invitation to tender to the participants qualified as suitable via the e-Procurement Register. All necessary information regarding the operation of the DPS and the rules and description of joining is contained in the procurement documents and the provisions of the Public Procurement Act and the relevant legal provisions. Every participant meeting the suitability condition is taken up in the DPS, the number of participants to be invited to tender is not subject to any limitation.
