In the national networks of the host countries of Dataport, there is a continuous need for fibre-based connections (Dark Fiber) due to new installations, relocations and closures of sites, as well as the replacement of existing connections. The contracting authority intends to introduce a Dynamic Procurement System (DPS) in accordance with § 120 (1) GWB in conjunction with §§ 22 – 24 VgV. Interested, suitable applicants can be admitted to this DPS throughout its entire duration. Within the DPS, the awarding of contracts is carried out in accordance with the rules of the restricted procedure (Section 22 (2) VgV). Currently, up to 1,000 Dark Fiber are planned to be awarded in the period between 2026 and 2033. Although the tender is valid for all host countries of Dataport, most of these already existing connections run within Schleswig-Holstein. These connections will be re-awarded within the Dynamic Procurement System after the expiry of their respective minimum contract period, which extends over the period from 2026 to 2033. This means that local suppliers with a limited expansion area should already participate in the selection competition, even though the first awards within their expansion areas will only take place months or even years later. To minimise the resulting uncertainty and administrative burden for all parties involved, the responsible department of Dataport, in the form of the Broadband Office, relies on proactive communication with the companies registered in the participant pool and will inform them via the tender portal during the term of the DPS about when and in which area awards are planned. The project-specific requirements and minimum criteria of the connections as well as the contractual conditions result from the tender documents, which are made available to the admitted applicants at the time of the invitation to submit an offer. For the information of the interested companies, a draft of an exemplary specification is attached to these participation documents. The contracting authority points out that the technical requirements, minimum criteria and contractual regulations can be adapted to the needs of the contracting authority during the term of the DPS or supplemented by new requirements. Furthermore, these can be extended by additional, optional minimum criteria for connections with special requirements. The contractor provides the contracting authority (Dataport) with a fibre-based connection (Dark Fiber) between the two specified endpoints.
