Description

The subject of the contract is the purchase and delivery of medical equipment, medical devices, and furniture necessary for the equipment of the AOS General Hospital in Kolno, in the quantity and assortment specified in Annex No. 2 to the SWZ. Number of parts: 8. The detailed description of the subject of the contract has been specified in Annex No. 2 to the SWZ, which constitutes a detailed description of the subject of the contract and technical requirements together with the assortment-price form. Information on the rules for the implementation of the subject of the contract, guarantees, and remuneration is contained in Annex No. 13 to the SWZ - contract template (applies to part No. 1, 3 and 6), Annex No. 14 to the SWZ - contract template (applies to part No. 2, 4, 5, 7 and 8). The procedure for awarding the public contract is conducted in the form of an unrestricted tender based on Article 132 of the Act of 11 September 2019 on Public Procurement (Journal of Laws of 2024, item 1320, as amended), hereinafter referred to as the "PZP Act". The procedure is conducted in accordance with the procedure applicable to procedures for supplies, the estimated value of which exceeds the amounts specified in Article 4(c) of Directive 2014/24/EU of the European Parliament and of the Council of 26 February 2014 on public procurement, repealing Directive 2004/18/EC (Official Journal of the EU L 94 of 28.03.2014, p. 65, as amended) amended by Commission Regulation (EU) 2025/2152 of 22 October 2025 (Official Journal of the EU L 2025/2152 of 23.10.2025), i.e. above 216 000 euro which constitutes the equivalent of the amount of 930 960,00 PLN. Contractors who are not subject to exclusion from the procedure on the basis of Article 108(1) and Article 109(1)(4) of the PZP Act, Article 7(1) of the Act of 13 April 2022 on special solutions in the field of counteracting the support of aggression on Ukraine and serving to protect national security (Journal of Laws of 2025, item 514) and Article 5k(1) of Regulation 2025/2033 of 23 October 2025 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (Official Journal of the EU No. L 2025.2033) and meet the conditions specified below, i.e. 1) have the appropriate technical or professional qualifications: They have properly implemented within the last three years before the deadline for submitting offers (and if the period of conducting business is shorter - in this period) at least one delivery of an ultrasound device, with a gross value of at least: - for part No. 1 – 220 000,00 PLN - for part No. 3 – 230 000,00 PLN - for part No. 6 – 350 000,00 PLN In the case of the remaining parts, i.e. parts No. 2, 4, 5, 7 and 8, the Contracting Authority does not set any conditions for participation in the procedure. 13) The subject of the contract will be financed within the framework of the European Funds for Podlaskie 2021-2027 project No. FEPD.04.05-IZ.00-0003/24 "Improving the quality and accessibility of AOS services at the General Hospital in Kolno". 22) The Contracting Authority, pursuant to Article 257 of the PZP Act, reserves the right to invalidate the procedure for awarding the contract if the public funds that the Contracting Authority intended to allocate for the financing of the whole or part of the contract have not been granted to it. Contract implementation deadline: no later than 30 days from the date of signing the Contract, but no later than 30.06.2026 - applies to all parts. GDPR information obligation - in accordance with the provisions of point 16 of the SWZ - "Information Clause - Article 13 of the GDPR". The Contracting Authority does not require the submission of a bid bond. The Contracting Authority requires the provision of security for the proper performance of the contract. Information on the security can be found in point 13 of the SWZ (applies to part No. 1 and 5). The Contracting Authority requires that the Contractor, when implementing the contract, applies the DNSH principle ("do no significant harm"; English: "Do No Significant Harm"). The implementation of the contract aims to limit the negative impact on the environment, promote environmental goals, including a circular economy and waste reduction. The Contracting Authority requires that the subject of the contract, and in particular its production and use during its life cycle, does not violate the principle of "doing no significant harm" (DNSH), as referred to in Article 17 of Regulation (EU) 2020/852 of the European Parliament and of the Council of 18 June 2020. Information on the rules of DNSH is described in point 3 of the SWZ and Annex No. 11 to the SWZ. Information for the Contractor who has a registered office or place of residence outside the territory of the Republic of Poland is described in point 6.5 of the SWZ. The Contracting Authority allows the possibility of submitting partial offers for individual parts. Each part constitutes an indivisible whole and is not subject to further division. In accordance with the provisions of Article 107(2), the Contracting Authority will call upon the Contractor to submit or supplement the subject matter evidence within the specified deadline in the event that the Contractor has not submitted the subject matter evidence or the submitted subject matter evidence is incomplete.
