Belgium – Surveying services – Raamovereenkomst betreffende de aanstelling van schatter-experts voor het schatten van residentiële onroerende goederen ten behoeve van het Vlaams Woningfonds bv

The contract concerns a framework agreement as referred to in Article 2, 35° of the Public Procurement Act, within the framework of which the conditions of the contract are fixed for a period of two years (and any extensions). The placement of Specific Contracts based on this tender does not give the Contractors any right of exclusivity. The Contracting Authority may, during the duration of the framework agreement, have orders, identical or analogous to those described in these contract documents, carried out by other entrepreneurs or by its own services. In such a case, the Contractors cannot claim any compensation for damages. The framework agreement concerns the performance of the valuation of residential goods for which a Flemish Housing Loan is requested at the expense of the Flemish Housing Fund. The valuation is intended for the estimation of the value of the property and for the listing of the necessary works that need to be done to comply with the safety, health and housing quality standards in accordance with Book 3, Part 1, Article 3.1 of the Flemish Housing Code of 2021. The valuation must be carried out in an objective manner and the expert valuer may derive no personal, monetary or business benefit from the valuation of the property. For this reason, the contract for expert valuer on behalf of the Flemish Housing Fund is incompatible with acting as an estate agent within the area of operation of the plot for which one is designated as a contractor.
