Poland – Software package and information systems – Dostawa i wdrożenie systemu zarządzania danymi klinicznymi klasy CIS dla Oddziału Anestezjologii i Intensywnej Terapii oraz elektronicznej karty znieczulenia dla bloku operacyjnego, wraz z integracją z systemem HIS i urządzeniami medycznymi

3.1. The subject of the contract is the supply and implementation of a CIS (Clinical Information System) class system along with the supply of necessary IT equipment, integration with HIS and the provision of service and maintenance support. The subject of the contract has been described and detailed in Annex 2 to the SWZ. 3.2. The subject of the contract must be marked in accordance with the applicable legal provisions and be allowed to be traded and used in Poland, have the necessary certificates and permits, if required by the relevant provisions.

3.4. The parameters and functionalities indicated in the OPZ constitute the minimum requirements, unless otherwise explicitly stated for a given parameter. The technical parameters given in the annexes should be treated as a model meeting the minimum requirements. The elements proposed by the Contractors may not have parameters worse than those given as a model.

3.5. The subject of the contract must be new, allowed to be traded on the basis of the applicable legal provisions and meet all the requirements specified by the legal provisions, and be free from any physical or legal defects.

3.6. The remuneration for the supply and implementation of the System will be paid in a single payment upon their acceptance. The remuneration for separate service and maintenance support services will be paid in arrears for monthly settlement periods. The payment term is up to 60 days from the date of delivery of a correctly issued invoice, on the terms specified in § 4 of the Contract Project.

3.7. Pursuant to Article 99(5) of the Public Procurement Law, in the event of the use of trademarks, patents or origin, source or special process, which characterizes the products or services supplied by a specific Contractor, the Purchaser allows tenders to be submitted for the described assortment or an equivalent. By an equivalent solution, the Purchaser means a solution meeting all the minimum functional, technical, quality, integration and safety requirements specified in the OPZ and ensuring the achievement of a result no worse than the solution described by the Purchaser.

3.8. Pursuant to Article 101(4) of the Public Procurement Law, the Purchaser, by describing the subject of the contract by reference to standards, technical assessments, technical specifications and technical reference systems, as mentioned in Article 101(1) point 2 and (3) of the Pzp, allows equivalent solutions to those described. The Contractor who refers to equivalent solutions described by the Purchaser is obliged to prove that the supplies, services or construction works offered by him meet the requirements specified by the Purchaser.

3.9. The contract will be implemented as part of Action 2.3. Digital Lubelskie in health protection (project type 1,2) Priority Transformation, economic and digital region of the European Funds for Lubelskie 2021-2027 contract number FELU.02.03-IŻ.00-0010/25-00. Separate service and maintenance support services are financed from the Purchaser's own funds outside the scope of expenditures presented for settlement in the project.

3.10. No division into parts: The Purchaser has not divided the contract into parts since the subject contract forms an indivisible whole from a technical, organisational and economic point of view. This decision does not restrict competition by limiting the possibility of tendering for the contract by smaller entities, in particular small and medium-sized enterprises. The subject of the contract and its size correspond to the capabilities of entities from the SME sector. The decision has been verified in terms of functionality and the methods of implementation applied, and the structure of potential contractors on the market relevant to the subject of the contract has been taken into account. The lack of division into parts is also related to the responsibility of one Contractor for the functioning of the whole. There will be less risk of disputes between the CIS supplier, infrastructure and integration, as well as a common acceptance procedure and one SLA, security of the ICT supply chain. Additionally, the alarm distribution chain from medical devices (device, server, wireless network, staff telephone) is a patient safety function and must be validated as a whole by one Contractor, and the server and network infrastructure is dimensioned to the requirements of the manufacturer of the offered system, so it cannot be sensibly ordered before the system is chosen.
