Description
The subject of the contract is the supply of computer equipment for the needs of Public Administration Units. 2. A detailed description of the subject of the contract and the method of its implementation has been specified in the Technical Specification - Annex 2 to the SWZ, in Annex 3 to the SWZ - Draft Framework Agreement Terms, and in Annex 4 to the SWZ - Draft Execution Agreement Terms. 3. The Purchaser may invalidate the public procurement procedure if the funds that the Purchaser intended to allocate for the financing of the whole or part of the contract have not been granted to them. 4. The Purchaser has determined the estimated quantity of the subject of the contract only for the purpose of evaluating the offers submitted by the Contractors, which will then be used to prepare the ranking of the submitted offers. 5. The Framework Agreement - in each part - will include the entire range listed in the submitted offers, i.e. each Unit during the validity of the Framework Agreement will be able to purchase any equipment, specified in the Technical Specification, which is Annex 2 to the SWZ. 6. Whenever in the SWZ, including in the Technical Specification, which is Annex 2 to the SWZ, the subject of the contract is described by referring to standards, trademarks, patents, or origin, source, or a particular process, the Purchaser allows the Contractor to offer an equivalent solution. 7. A Contractor who refers to solutions equivalent to those described by the Purchaser is obliged to demonstrate that the equipment/software offered by them meets the requirements specified in Annex 2 to the SWZ. The equivalence in terms of technical, usability, or operational parameters should, in particular, ensure the achievement of technical parameters no worse than those accepted by the Purchaser. 8. The Purchaser informs that the execution procedures during the validity of the Framework Agreement will be conducted through the Platform at the address: https://zamowienia.eb2b.com.pl or https://platforma.eb2b.com.pl, which will require the Contractor to use a qualified electronic signature. The Platform has the following functionalities: transmitting the "Invitation" to participate in the execution procedure, submitting a response to the "Invitation" by the person/persons designated by the Contractor, conducting other correspondence between the Contractor and the Purchaser or Units, including the transmission of agreements for signature, and reporting. 9. The scope of the execution contracts will each time be determined by the Units in the "Invitation" to participate in the execution procedure. 10. The Purchaser requires the submission of the subject matter evidentiary means listed in the Technical Specification - Annex 2 to the SWZ, along with the offer. The Purchaser, in the event of non-submission by the Contractor of the subject matter evidentiary means or if the submitted subject matter evidentiary means are incomplete - allows the possibility of calling the Contractor to submit or supplement them, within the specified deadline, unless, despite the submission of the subject matter evidentiary means, the offer is to be rejected or the grounds for invalidating the procedure occur. 11. Information regarding financing or co-financing. The contract for the needs of: 1) the Ministry of Health is co-financed from the European Social Fund Plus within the Programme European Funds for Social Development 2021-2027 and from the Cohesion Fund within the Programme European Funds for Infrastructure, Climate, Environment 2021-2027, 2) the Warmian-Masurian Voivodeship Office in Olsztyn will be co-financed from the funds of the Asylum, Migration and Integration Fund for the years 2021-2027 in connection with the implementation of the project no. FAMI.02.01-IZ.00-0003/24 entitled „Warmian-Masurian accessible for legal migration" co-financed from the funds of the European Union, 3) the Ministry of Climate and Environment is co-financed from the European Funds for Infrastructure, Climate, Environment, 4) the Lower Silesian Voivodeship Office in Wrocław will be co-financed from the funds of the Asylum, Migration and Integration Fund for the years 2021-2027 and the Solidarity Fund, 5) the Chief Geodesy and Cartography Office is co-financed from the funds of the European Union within the project entitled Ensuring the availability and use of innovative network services and spatial data by citizens and entrepreneurs, along with improving the safety, health and human life provided by the public administration (Smart Geoportal), agreement no. FERC.02.01-IP.01-0006/25-00, 6) the Ministry of Funds and Regional Policy is financed from the funds of the European Union from the programme Technical Assistance for European Funds 2021-2027 and from the state budget, 7) the Chief Inspectorate for Environmental Protection will be financed from the funds of the European Union, 8) the Ministry of Culture and National Heritage will be co-financed from the funds of the European Funds for Infrastructure, Climate, Environment 2021-2027 (guidelines regarding the eligibility of expenditure for the years 2021–2027) and the European Economic Area Financial Mechanism 2021-2028 (guidelines on awarding contracts under the EEA Financial Mechanism for the years 2021–2028 and the Norwegian Financial Mechanism for the years 2021–2028). II. CONTRACT VALIDITY TERM The validity term of the Framework Agreement: 12 months from the date of its conclusion or until the exhaustion of the financial resources allocated for the implementation of the subject of the contract, depending on which occurs first. III. EXECUTION CONTRACT PERFORMANCE TERM 1. The execution term for each part of the contract is no longer than 30 calendar days from the date of the conclusion of the execution contract. 2. The execution term for the execution contract is a criterion for evaluating offers in the procedure for concluding the Framework Agreement and will be binding for the Contractor at the stage of implementing the execution contracts.
