Description

The subject of the contract is the performance of construction works consisting of the renovation of 5 staircases in the building at ul. Franciszkańska 10 in Suwałki. 2. The detailed scope of the Contractor's obligations is specified in the contract project constituting Annex No. 7 to the SWZ. 3. The detailed description of the subject of the contract is contained in Annex No. 2 to the SWZ – Description of the Subject of the Contract (DSC). Additionally, the Purchaser provides the list of works as an auxiliary document. 4. The list of works is an auxiliary and informative document, from which the Contractor may use when preparing the offer, but it does not constitute the basis for determining the full scope of the works. 5. All works must be carried out in accordance with the DSC and applicable technical conditions and regulations. 6. The required warranty period for quality and guarantee, counting from the date of the final acceptance of the works: minimum 48 months, maximum 60 months. 7. In accordance with Article 101(4) of the Act, in the place where the subject of the contract is described using standards, technical assessments, technical specifications and technical reference systems, the Purchaser allows equivalent solutions to those described. Furthermore, it should be assumed that all such references are accompanied by the words "or equivalent". The indication of the equivalence of the offered solution in accordance with Article 101(5) of the Act and on the principles specified therein lies with the Contractor. In the case of a description using standards, equivalent solutions are considered to be those that ensure the fulfilment of the minimum requirements specified in the standard at a level not worse than described in the relevant standards. In the case of standards referred to in the SWZ (if not specified in detail) the current standards are understood. In other cases (description of the subject of the contract using technical assessments, technical specifications and technical reference systems) an equivalent product, material or system is considered to be one with technical, functional and quality parameters not worse than those mentioned in the description of the subject of the contract. 8. If the description of the subject of the contract includes a provision resulting from the KNR or KNNR indicating the need to use specific equipment with specific parameters for the implementation of the contract, the Purchaser allows the use of other equipment provided that it ensures the achievement of the design parameters and does not pose a risk of non-compliance of the completed works with the technical documentation. 9. Whenever in this SWZ the subject of the contract has been defined by indicating trademarks, patents, origin etc., the intention of the Purchaser was to present the "type" of goods meeting the requirements of the Purchaser. Furthermore, it should be assumed that all such indications are accompanied by the words "or equivalent". In connection with this, it is permissible for the Contractor to offer an equivalent solution that will guarantee no worse parameters, technical and quality standards and functional standards than those indicated in the SWZ. The Contractor who refers to solutions equivalent to those described by the Purchaser is obliged to indicate in the submitted offer that the supplies offered by him meet the requirements specified by the Purchaser. 10. In accordance with Article 246(2) of the Public Procurement Law, the quality requirements relating to the main elements constituting the subject of the contract have been specified in the Description of the Subject of the Contract and the contractual provisions being drafted. 11. The works must be carried out in a manner that ensures the uninterrupted operation of the building and the service premises located therein. The area of the works must be appropriately secured against access by unauthorised persons. The Contractor is obliged to continuously coordinate with the Purchaser the organisation and schedule of the works in the scope affecting the operation of the building and to carry out the works in a manner that minimises inconvenience to the users of the facility.
