The subject of the procedure is the conclusion of framework agreements for the supply of network switches, hereinafter referred to as the assortment. 2. The detailed description of the subject of the order is set out in Section XIX/XIXa of the SWZ and Annex 5 to the SWZ. 3. The Contracting Authority requires the Contractor to offer a minimum guarantee and warranty period of 24 months, calculated from the date of signing the protocol for the quantitative acceptance of the delivery. The warranty period may not be shorter than the guarantee period. 4. The Contracting Authority does not require the submission of subject-specific evidence with the offer. 5. The Contracting Authority requires the indication in the price form (col. 5 of the table in Annex 6 to the SWZ) of the producer, model, type, symbol or other data uniquely identifying the offered assortment. In the event that the offer does not indicate data uniquely identifying the offered assortment or does not submit Annex 5 to the SWZ with the offer, the Contracting Authority will reject the offer on the basis of Article 226(1)(5) of the Act. The term "producer" shall be understood to mean the name of the company under which the offered assortment is sold, or the entrepreneur introducing the goods to the market in the territory of the Republic of Poland. 6. The Contracting Authority requires that the offered ICT products do not include: 1) ICT products indicated in the recommendation referred to in Article 34(4) of the Act of 5 July 2018 on the national cybersecurity system, stating their negative impact on the fundamental interest of state security; 2) an ICT product whose type has been determined in a decision on the recognition of the supply as a high-risk supplier, as referred to in Article 67b(15) of the Act of 5 July 2018 on the national cybersecurity system; Non-compliance with the above requirement will result in the rejection of the offer on the basis of Article 226(1)(17) or (19) of the Public Procurement Law (i.e. Journal of Laws of 2026, item 793 as amended). 7. The trademarks, patents or origin, sources or special process, which characterise the products or services supplied by a specific contractor, as referred to in Article 99(4) of the Act, and the standards, European technical assessments, approvals, technical specifications and technical reference systems, as referred to in Article 101(4) of the Act, used by the Contracting Authority in this documentation, constitute only a qualitative, functional, technical, technological or aesthetic model and in all cases of their use, the use of equivalent materials, devices, technical systems and other elements, hereinafter referred to as "equivalent solutions", is permitted. The specified materials, devices, technical systems and other elements described using "restrictive phrases" may be replaced by equivalent solutions with correspondingly not worse technical, technological, aesthetic and not worse quality or functional characteristics described in this documentation. The use of "restrictive phrases" does not aim to prefer a given producer or its product, but serves only to indicate a solution that should have properties and characteristics not worse than those indicated in this documentation. The Contracting Authority will, in the case of offers containing equivalent solutions, verify them in terms of meeting the requirements of the individual positions of the requirements contained in this documentation. The Contractor is obliged to prove the equivalence of the offered materials in the offer. The Contracting Authority will not recognise the offered solutions as equivalent if they have worse properties or characteristics than those indicated in this documentation. 8. The Contracting Authority does not allow partial offers to be submitted. 9. The Contracting Authority allows the execution of part of the order to be entrusted to a Subcontractor. 10. The Contracting Authority requires the Contractor to indicate in the offer the part of the order, the execution of which will be entrusted to Subcontractors, and to provide the names of any Subcontractors, if they are already known. 11. Order fulfilment period: no longer than 180 working days, calculated from the date of conclusion of the contract or acceptance of the requirement. 12. The procedure for placing orders on the basis of framework agreements is described in Section XIX/XIXa of the SWZ. 13. In the event that, as a result of the subject matter of the procedure, an agreement is concluded with one Contractor, the Contracting Authority will award a public order on the basis of Article 313 of the Act, i.e. on the basis of a framework agreement, the template of which is Annex XIXa to the SWZ. 14. The type and scope of the changes to the agreement are indicated in Section XIX/XIXa of the SWZ. 15. The Contractor is bound by the offer for 90 days from the expiry of the offer submission deadline, with the first day of the offer being the day on which the offer submission deadline expires, i.e. until 9 January 2027. 16.
