The Framework Agreement covers the supply of stoma, compression and TAI products (Stoma Products) to the Municipalities' potential own stocks, supply of Stoma Products to Citizens and – based on the winning Tenderer's unit prices in Annex 3a – Offer List – determination of the Municipalities' grants to Citizens with an entitlement. The procurement of Stoma Products will primarily be made by Citizens based on the Municipalities' entitlement to Citizens. The Municipalities will, in connection with the entitlement to Citizens, inform Citizens that Citizens can purchase the entitled products without self-payment from the winning Tenderer. The chosen supplier will thus function as the Municipalities' primary contract supplier and reference basis for grant determination. The Buyer intends to enter into the Framework Agreement with one supplier. Citizens' procurement of Stoma Products is covered by the Danish Act on Public Procurement, Section 112, which means that Citizens have free choice of supplier, and which results in the Framework Agreement being non-exclusive for the Supplier. Since Stoma Products are covered by the Danish Act on Public Procurement, Section 112, and since Citizens' need for these aids varies over time, the Municipalities cannot guarantee the Supplier a certain volume during the Framework Agreement's term. The Municipality will, in connection with the issuance of the entitlement, inform Citizens that Citizens have free choice of Supplier, but that it is possible to purchase the entitled products from the Supplier without self-payment. The Danish Act on Public Procurement's provisions on free choice of supplier also mean that the Municipality, where Citizens choose a different supplier than the winning Tenderer to supply the products, does not in all cases have the possibility to maintain confidentiality regarding unit prices. The Municipalities are obligated to inform the entitled grant for stoma aids on the entitlement, and this amount will follow the unit prices from the winning Tenderer. The following municipalities have joined together to tender a Framework Agreement regarding the supply of Stoma Products etc. according to the contents of Annex 3a – Offer List: Allerød Municipality, Bornholms Regionskommune, Fredensborg Municipality, Frederikssund Municipality, Furesø Municipality, Halsnæs Municipality, Helsingør Municipality, Herlev Municipality, Hillerød Municipality, Hørsholm Municipality.
