A sector dialogue and market survey have revealed that the contracting authority currently has no high-performance gigabit infrastructure with an offer of corresponding telecommunications services available throughout the area in accordance with the goals of the Gigabit Framework Regulation 2.0, and will not have such infrastructure available in the coming years. The contracting authority has therefore applied for funding for a comprehensive gigabit rollout in the viability gap model under the "Guideline for the Promotion of the Support for the Gigabit Rollout of Telecommunications Networks in the Federal Republic of Germany - Federal Gigabit Guideline 2.0 (Gigabit-RL 2.0)" of 31 March 2023 in the version of the 1st amendment of 30 April 2024 ("Gigabit-Richtlinie 2.0") and received the notification of the final amount of the grant. The funds provided in this funding programme in the viability gap model (hereinafter: funds) are to be passed on by the contracting authority to telecommunications undertakings in the sense of EU state aid law as investment cost aid for the construction and operation of gigabit networks.
