Germany – Pharmaceutical products – Abschluss nicht-exklusiver Rabattvereinbarungen nach § 130 a Abs. 8 SGB V für Verträge biosimilarer Wirkstoffe

Section 130a (8) SGB V allows statutory health insurers (KK) and pharmaceutical companies to conclude framework discount contracts for prescription drugs to be dispensed at the expense of the statutory KK. The GWQ acts as the Society for Economy and Quality for KK pursuant to Section 130a (8) Sentence 5 SGB V for its shareholder and customer funds. With regard to the relevant legal provisions for the award of public contracts, a regular process of substance-related, formal tendering procedures according to the regulations of Part 4 of the GWB is carried out by the GWQ ServicePlus AG. Until the entry into force of new pharmaceutical discount contracts, the GWQ wishes to conclude pharmaceutical discount contracts with all interested pharmaceutical companies. The contract start date is 01.04.2026.
