Germany – Pharmaceutical products – Abschluss einer nicht-exklusiven Rabattvereinbarung nach § 130a Abs. 8 SGB V zum Wirkstoff Clobazam (ausschl. Dafo TAB), ATC N05BA09 für die Zeit 01.06.2026 - 31.05.2028 (zzgl. V.-Option 1x12 Monate)

Section 130a, paragraph 8, of the German Social Code (SGB V) allows health insurers and pharmaceutical companies to conclude framework discount contracts for medicines to be dispensed at the expense of the statutory health insurers. With regard to the relevant legal provisions for the award of public contracts, a regular process of substance-related, formal tendering procedures according to the regulations of Part 4 of the German Act Against Restraints of Competition (GWB) is carried out by DAK-Gesundheit. For medicines to be specified by the bidder in more detail in Annex 2 to the contract, relating to the aforementioned active substance Clobazam (exclusively in the TAB dosage form), ATC N05BA09, DAK-Gesundheit intends to conclude pharmaceutical discount contracts with as many interested pharmaceutical companies as possible until the entry into force of new pharmaceutical discount contracts. A discount contract under the approval model for the aforementioned active substance will come into force for the first time on 01.06.2026 and will end on 31.05.2028 (plus extension option 1x12 months). It will end automatically with the entry into force of the exclusive contract, regardless.
