The subject of the contract is the Supply of medicinal products. 2. A detailed description of the subject of the contract is in Annex 1a to the SWZ. 3. The subject and the conditions for the implementation of this contract must be in accordance with the Act of 6 September 2001 on Pharmaceutical Law and other applicable legal provisions in this area. 4. The subject and the conditions for the implementation of this contract must be in accordance with the Act of 7 April 2022 on medical devices and the Regulation of the European Parliament and of the Council (EU) 2017/745 of 5 April 2017 on medical devices or the Regulation of the European Parliament and of the Council (EU) 2017/746 of 5 April 2017 on in vitro diagnostic medical devices (where applicable) and other applicable legal provisions in this area. The subject of the contract must have a CE declaration – this applies to Packages 5 and 6. 5. The contracting authority does not envisage the possibility of awarding contracts, as referred to in Article 214(1)(8) of the Pzp Act. 6. The subject of the contract has been quantified on the basis of units such as: tubes, bottles, ampoules, vials, tablets, etc. The contractor provides medicinal products, the collective packaging of which does not exceed 100 units, and excludes from the valuation medicinal products known as hospital packages – packs. 7. The contracting authority allows the substitution of equivalent forms of medicine, e.g.: Infusion solution, injection solution, concentrate for preparing injection solution, or tablets, coated tablets, capsules. 8. Medicinal products with different dosages within a package must constitute one product, i.e. come from one manufacturer, as only this allows for the combination of medicines within the same active substance – this applies to Package 25. 9. The contracting authority requires that the medicines offered are on the list of reimbursed medicines on the basis of the Regulation of the Minister of Health, current on the date of submission of the offers, and the offered price may not exceed the amount of the financing limit for the given active substance - for the given medicine.
